I wonder if they really don't understand that when the detective swore on the warrant the video was "taken off" of Nick's channel, he means COG took it off his channel. I can see how the language can confusing, but there simply is no lie. That wording can apply to either instance.
It's gotta just be willful ignorance. Nick is one of those guys that thinks being right on a technicality is clever and badass. Anytime he's making some retarded argument it's about the specific wording or interpretation of something.

Nobody in their right mind would frame an appeal like this, and repeat the same glaring mistakes that forced a judge to watch the Cokestream.

Rulings related to the suppression of evidence are among the types of orders most insulated from interlocutory review. There is nothing that prevents the issue from being heard on appeal, and allowing such appeals would ruin the efficiency of the criminal justice system. Every criminal would claim their case involves some novel application of law and requires interlocutory review, grinding trials to a halt throughout the state.

I hope the appellate court just summarily says that this isn’t an issue that meets the burden necessary for an interlocutory appeal, and punts it back to trial.

Also note that the trial judges will see this and be annoyed that the case is being dragged out by a litigant who should ostensibly know that this is a dumb and time-wasting tactic. The prosecutors, too. That plea deal is going to get worse and worse as Nick spergs out all over the Minnesota judicial system.
 
Bold move to appeal a judge's decision to deny you a hearing where your remedy would be to have the hearing that the judge thought had no merit to begin with. Can't imagine what the eventual result of that would be!
It's not bold for Rekieta, since he already tried essentially the same thing with his civil trial with Monty as well.

It's objectively stupid, however.

Hey now, this is a different judge and surely it will work. And you know what Nick if this judge is some Scandinavian prude you can always appeal it to the MN Supreme Court. And if tht fails there's the US Supreme Court. Don't let 16 denials stop you from filing your next appeal, you gotta win eventually.
