Hypothetical: If aaron did plant drugs, talk to the church members or otherwise do something to get Nick in trouble and he knows this due to illegally obtained proof (emails, calls, etc), will that proof be tossed out? You can't use stolen proofs in court, right? So hacking crimes aside he might have also erased his ability to clear his name in the current case? He's been talking about having magical evidence that will clear his name for months now and I bet it was acquired via this hackery.
The prosecution in a criminal case cannot use illegally obtained evidence. But the defense side in a criminal case is not under the same obligation. Exculpatory evidence in a criminal case in particular can't really ever be disregarded.
But its worth considering that obtaining that evidence can expose a person to additional criminal charges not related to the original charge. And those charges can sometimes have higher penalties than the original charge.
