Dave Brian Muscato / Danielle Tatiana Muscato / Danielle Brian Muscato - Half-Assed Trans Activist, Fully Arrested, Rape Appropriator, Currently Trying to Extort His Parents

I love that Dave's base of quality (economic, anyway) is Wendy's. How expensive was this burger compared to Wendy's? Imagine the volume of stuff one could have bought at Wendy's if he'd eaten there instead.

And the dark times too -- stopping off at Wendy's for a soda and his car getting booted/towed. Wendy's fat-shaming someone.

Such a far cry from his pizza making and antipasto platters when he was in Kentucky. Or dining out in NYC.

Dave's still a snob, of course, but I miss culinary snob Dave. Handmade pasta Dave. Irregular (excuse me, rustic) pizza Dave. The Dave who steals from the country club (with wine pairings). "Common People" Dave.

Updates: Prosecution filed for discovery. Defense motion for continuance denied. Per @Bookwork, it looks like this circus may actually roll into court 12/4.

It’s quite normal to want to use your remaining healthy years to travel. Dave is content pissing his life away, with no ambition beyond lashing out at his parents. So it’s easy to see why he wouldn't understand people wanting to experience the world while they can.
He’s pissed they’re spending their money because he’s counting on a yuuuuuge inheritance. You can practically feel the frenzy while he’s rabidly pocket-watching, listing off the things they spend on instead of hoarding it for la princesa. I know I’m preaching to the choir here but it’s really gross how he’s treating his parents like thieves for enjoying the fruits of their labor. Being incensed that his elderly parents aren’t living barebones so that he can live large when they pass, I wonder what kind of arrangement they have in their wills.

From what I can tell, it looks like this will be public but not broadcast. It looks like this is the actual trial and could therefore actually be interesting. Or does anyone with a better understanding of how things work where Dave lives have a different take? Will we get full transcripts eventually? This thread is pretty small so I have to assume we won't get any field agent there, unfortunately.

@Cats is a gestalt of many, many felines, and each one of them has an account.

We are Many. We are Legion.

You're most likely right that this won't be streamed. So far, the only livestream I'm aware of was during Dave's first appearance in court to answer the charges, amuse the rest of the people answering charges, and complain about his name. We'll have Dave's side of the story, of course, set to the same, incessant guitar riff. Unless that's reserved for the brother who stole his sensual-shower girl.

Yeah, since writing that I found this. Not scheduled for a virtual hearing.davecourt.png
I got slightly concerned when searching brought me to a page which states that transcripts have to be requested 14 days in advance of proceedings (which is tomorrow), but that's for the East Missouri District, which does not include Columbia and seems to be a higher level of court anyway. And it seems that deadline only implies if you're requesting transcripts as they come out.

I hope we do get something but I have no knowledge of the US legal system so unless I put in some serious time, I doubt I'll be the one to figure out what has to be done. We'll probably have to wait but I'm sure something will come out.

The Sub Shop, a Columbia institution for 49 years has closed down. Dave sounds in.

Between this and Kroger Andy it’s almost like Dave doesn’t care for the working man. He’ll just stick to his corporate overlords.
I'm suprised he doesn't have one of those customized reddit aliens that looks like a woman. Dave's restraint is truly an example for us all. Do you have to pay for them with cash or points or something?

Shit I didn't realize this nigga was set for a felony jury trial? I thought it was going to be a couple hour bench trial on some A misdemeanors.

Do we know how he got his lawyer? It's not a public defender, so he either paid the guy or this is some charity deal. If he paid he's probably looking at $15k minimum.

Starting a jury trial on Wednesday is weird. Missouri allows jury selection by parties so some portion of the proceedings will be non-public jury selection. It may take up to the whole first day, but probably just until ten or eleven. The prosecutor may open before lunch.

https://www.courts.mo.gov/hosted/circuit13/geninfo/judges/jdgdiv03.htm this is the judge and it also has his court reporter's info, a transcript will probably cost around $800 a day to be prepared. If his lawyer appeals then we may be able to get a copy cheaper because then you're not paying to have it prepared, only for a copy. There's no rule about having to order it ahead of time.

I'd say Dave is pretty optimistic about his chances at an inheritance. if I were Doctor Joe I'd use the old saw;

And to my son David I leave my best wishes and nothing else.

If ole Davey is expecting to cruise thru his retirement on his parents money I'd say he's in for a pretty rude awakening when that day comes.

It's been a minute since I looked it up, but I believe they were the lowest class felonies, short of being misdemeanors. Given Dave is a "first-time" offender, I'd assumed they'd done that to work out a plea deal, bump them down to misdemeanors (maybe even drop one of the charges -- likely the food/champage theft). Given Dave's POV, I assume he'll reject anything offered.

He's used this attorney before, I believe. Was it for the Tennessee charges? (I need a refresher on the thread before the trial starts, update the timeline.)

Perhaps he sold a few guitars from the collection? Dave's finances have always intrigued me. I assume while he was pleading poverty and surviving on his Patreon earnings (I remember when his Patreon was substantial-ish; I spent a summer watching it drop -- what a time!) that his parents were sending him something to keep body and soul together. And to keep him away.

I also assume this amount would seem to the average person very generous (certainly enough to keep Dave supplied with weed, "magic" mushrooms, commemorative tattoos, and cured meats). When Dave's real nastiness came in, after he "fled" to the motel, I assume that was bc his parents finally cut him off. A true blue temper tantrum that continues to today.

Then again, who knows? Joe let Dave bully him into a payment outside the therapists's office, after Dave cornered Mary in her car, while that friend was filming. It's the image that pops into my head whenever Dave talks about Joe-the-meanest-man-I-know, this poor, older man being browbeaten and whined to by his "crippled" son, with guitar and amplifier strapped to his belly. Who also admitted he knows he shouldn't be there. Makes me do a proper Mary eye roll. I hope she spends his inheritance on chest freezers and the duct tape/bungee cords to keep them shut.

@waffle, thanks for the court info! Also, I'd like to thank everyone who keeps this thread going -- Dave was one of my first cows, and I hope the trial can stir up some nostalgia for the thread. (If Kyle "Katelyn" Burns could have one more fight with Jesse Singal, that'd be rainbows!)

When was the last time he had an actual no bullshit job.
I don't know about no-bullshit, but the last job he got a proper paycheck for was American Atheists (2013-2015). I say that, bc if you've seen any of his interviews... he was not a great PR person. He's mentioned working BOH in restaurants (I'll give him credit -- he's obviously had kitchen training). Otherwise, it's volunteer work with skeptic/atheist groups, food/meal delivery, and his RESIST podcast (still waiting on those Jameela Jamil, Rose McGowan interviews to drop). Unrelated, but does anyone know whatever happened to his producer Esther?

TLDR: You're looking at someone who hasn't worked in 10 years, and likely had no steady employment prior. Which is why he understands the working class's perspective and needs. And tries to get them fired, ha ha.

Lastly, there had been some talk of updating Dave's OP. I might give it a swing in the next couple of months, maybe post something in the thread for feedback. I've been doing "deep dives" with some other people I follow and have considered doing something similar for Dave. I'd love to revisit some favorite moments: Dave making an ass out of himself during the Mizzou protests, Dave in the women's shelter, trying to sort out the stories about the brothers (particularly Andy's "obsession" with having a mixed-race child). If anyone has any requests, thoughts, etc., give me a holler.

It's the end of the year, and I guess I'm feeling nostalgic, ha ha.

It probably would have been the later but Dave is a genius and saw the potential for a ground breaking legal precedent. He's finally have his chance to expose evil Dr. Joe Muscato and the corrupt Columbia Police Department. He's going to put the whole system on trial.

Has it been noted on here yet that the prosecutor fucked up and uploaded two copies of the PC statement as publicly viewable? One of them has all of Dave's personal information including SSN, driver's license number, and FBI file number unredacted on the last page. (Edit, they are different, and like supplementary to each other, but the one closer to the bottom is still improperly redacted to the max.)

Interestingly that also disclosed that he HAS an FBI file, so they tried for federal charges. The probable cause statement reads like his parents are fucking done with him. Also, LOL he charged up over a thousand bucks in four meals - for that good old felony theft.

-2nd edit- @eggs_over_easy count one is one to seven in the state pen. He would probably qualify for parole after six months in prison if this is his first time, but not if he is a problem.

Has he had his gizmo surgically removed?

Any chance us non law people can see a copy? SSN redacted, I understand it's illegal to share one?

Since it's public record, we must cherish.

I hid the SSN to keep Jersh out of jail. Full probable cause statement attached in case it's not somewhere already on thread I'm too assed to scroll through right now. The FBI# could be a product of the Tennessee bust.

Missouri Title Loans?
  1. Did Dave take a loan out with his shitty van as collateral?
  2. Did Dave claim that loan as his employeement?
  3. Or did he actually get a job signing up marginalized members of his community for predatory loans?
