Nick being more like Saruman also tracks with becoming like a Balrog/ Balldo of Morgoth. Balrogs are Istari who have fallen to the shadow, unlike Istari (wizards) like Gandalf who stayed true to the Valar & their mission. Always thought that was neat that Balrogs are the dark counterpart to wizards in Tolkien’s works. So, even if Nick is more like Saruman, rather than a full fledged Balrog/ Balldo of Morgoth, he’s still the same race of creature, regardless of which. My only concern is that Nick being of a powerful race like the Istari isn’t really believable. Nick is more like a human wastrel, someone like Gríma Wormtongue, a stooge of Saruman who thinks he’s more powerful & important than he is. But Balldo of Morgoth was too funny & clever (for LotR nerds,) so it works well.

So what are the chances hes actually just lying? It could be that the agency has said they WILL grant full custody depending on the outcome of his court case. It also could be that hes been so felted the last few weeks hes just straight up lieing.

Kristen Pierce is the prosecuting attorney in BOTH cases. She may have agreed to close the CPS case because she knows the plea deals that are coming. They will require drug testing and strict oversight.

That’s probably the correct answer, since it balances the least amount of effort with the largest possible disaster in the future.

That was always going to be the case. As a first time drug offender, even with second degree quantities of cocaine, Nick was always going to be offered two years of probation and deferred adjudication.

I have no idea how feasible it is, but mandatory drug testing for the entirety of his probation and having to plead guilty to the child endangerment charge are two things I want to see out of a plea deal.

When you're on probation, is it like bail that you have to be law-abiding? Would his "hacking" Aaron stunt mean that - if they charge him after he pleas to the drugs etc - that he's violated that stipulation? Or does it not count as the crime was committed before he pled?

I won't bother doing a bunch of quoting here, but I agree with the kid testing positive being legit. They will retest an 8 year old. This isn't gonna be some shit where they just do one quick test and wing it. Nick claiming he wouldnt face more serious charges is bullshit, because it would be rolled into endangerment or something else. Why? You can't really prove how the kid got the drugs, but you can prove that it was a result of negligent parenting. Nick has a big fuckin mouth too so if there was another test and anything ever came back anything besides positive, he would be swearing up and down all over the place about it.

Why would they retest if they had no path to criminal charges? I think the only reason they tested the kids was to determine what medical treatment they need. A positive test just triggers an eval for drug treatment. If the children suffered a serious injury from drugs (i.e. OD or addiction) I can see them going down the criminal route with criminal testing protocols. But just to determine treatment, a single positive test triggers a psych eval not retesting. No need to retest. If I'm the GAL, a positive test triggers med treatment. A followup test whether it's pos or neg isn't going to change that plan. A false neg is more likely than a false pos so retesting with conflicting results triggers a 3rd test. It becomes analysis paralysis when all I want is a doctor to determine if drug treatment is needed for the kids. I don't really care how Nick feels about the positive test.
