The Background:

The complete backstory for this case starts in the tangled ComicsGate lore, but the relevant facts are that Eric July (a recent-comer to the indie comics scene) had a falling out with Ethan Van Sciver and others in the ComicsGate community. Dax Herrera (a.k.a. Juju the Cow, the man who the man you loves to dress as a cow while getting pegged in the arse) took the side of EVS and others against July in an online slapfest that continued between the named parties and their own supporters. As a sample of the mutual fracas, July engaged in the online slapfight to 'monetise [his] haters', and threatened legal action for copyright abuse--eventually having archives of his comic taken down from Twitter and a parody logo t-shirt campaign suspended under internal DMCA process. On the other side, Dax and his supporters alerted a Christian ministry that shared the same acronym as the name of his comic series which resulted in a prolonged legal negotiation that ended in a settlement agreement between Eric's company and the ministry. They also raised the spectre of fraud allegations in relation to a charity fundraiser that Eric ran based on an inarticulate explanation of cost accounting from Eric. There is a lot of animus between the sides.

At a certain point, Riley Mix (editor for Juju's podcast) began to parody July's online persona 'YoungRippa59' as 'YoungClippa' and began to make online media on a dedicated and parody branded YouTube Channel mocking Eric, his comic, and supporters. Eventually the online jokes escalated into trolling super chats and alleged threats to 'shave [Eric's] arms' and show up in person. After being blocked on YouTube and social media by Eric, Riley's behaviour culminated in real life appearances at Eric's business place and meetups--a feat that required Riley to drive long distances across the United States multiple times. Upon arrival, he would film himself outside the location 'looking for Eric' and questioning Eric's courage. He would return to each location multiple times to film, both in the day and night--eventually taping money and stickers to the windows of the rented space July used for his comic shipping operations.

July's on-site manager would call the police, and Riley would leave the area. When the police arrived, they conducted a search for Riley's person and vehicle around the business park location, but found nothing. The basis for the call was the business manager citing that his employees were put in fear, and business interference. Riley would return later that night, filming himself sticking money and trolling bunny stickers on the location's front windows.Responding later, Eric capped off his official response with a claim that by returning at night, Riley put himself in damger becaise could legally be shot in Texas in self-defense. These actions would result in a police report being filed and a Texas warrant being issued for Riley on the charge of 'stalking' that was later revised to 'electronic harassment'.

Undeterred, (and supposedly not knowing about the warrant) Riley showed up in costume on June 8th, 2024 strip mall where Eric was hosting an event at a bar for his fans. After being asked to leave by the owner of the bar venue owner, Riley continued to operate and stream from the parking lot. Police were eventually called, the active warrant was found under Riley's name from the previous retail location incident, and Riley was arrested. Bodycam footage of the arrest was obtained and posted to Rumble. #1 #2 #3 #4 by Null.

After the arrest a GoFundMe | Archive was setup for Riley's legal expenses and has reached over 8,000 USD. Riley posted bail shortly afterwards and was released the next week after being held over the weekend.

The Charges:

Riley is charged with a Class B midemeanour harassment under Texas statute 42.07.

1732818180032.png

The punishment for a Class B midemeanour is up to 180 days in prison and/or a fine up to 2,000 USD.

The case record is here: Case# 001-87528-2024

Status:

After arrest and posting bond, Riley's attorneys challenged the charges under constitutional grounds, but their argument was deferred to a December 12th hearing.

On November 14th, 2024, Riley pleaded 'NOT GUILTY' to the charges, and a trial date was set for January of 2025.

1732818480106.png

On December 12th, 2024 a hearing was possibly held on Riley's motion to quash information and the State's response. On December 13th, 2024, the judge granted 2 potions of the motion.

After multiple motions back and forth, eventually the State filed a motion to dismiss the case, citing the lost information from the granted motion to quash and uncertainty in their confidence in pursuing the case. This was granted by the judge some days later.

Only six months and 2000 bucks at max? How bad is this for Riley, as in financially, if he just has to eat the fine?

I am sure that between Juju, EVS, Mint Salad simps, and the other July-haters, they can raise the money. Besides, if Riley spends any time in prison, they can just cry more about how the big meanie Eric put a man in prison for LAUGHING AT HIM!

If he has 2 grand lying around, not too terrible. However, that 2 grand is BEFORE the court costs get added on, assuming he doesn't do anything else that gets him into further trouble.

On top of that, unless he has a savings account that builds interest every month, assuming he serves the full 6 months, whatever work he normally does, no way does that while behind bars. Remember, even the Mafia understood that if you're behind bars, you aren't earning for your family.

Only time will tell though.

I imagine he gets one or the other tbh, not both, unless he royally pisses off the judge. The legal system likes doing as little as possible. Getting fine money out of him and calling it good is likely what's going to happen

It's worth pointing out that said settlement agreement was basically "this is retarded, this isn't infringement and there's no realistic chance of confusion so let's just keep doing our things and keep them separate".

He works for Juju full time and lives with his retarded OF girlfriend, Mint Salad. He will be fine. He found time to make his whole life about trolling a black man in Texas and cross the country multiple times to show up and harass him.

This is not a gainfully employed participant in society.

True. I started putting more detail in the background, but it started bloating out into all the CG and Sektur shenanigans, so I opted to keep it narrowly focused on the case itself. These kinds of details will bleed in naturally over time to the thread.

While it is rare for someone to get the maximum for both jail and the fine, it isn't unheard of for those convicted of misdemeanors to receive both in some capacity. For example, he ends up receiving 3 months and a $500 fine.

I could see that tbh. Really it would come down to how much of a nuisance the Judge thinks he was. That would come down to Eric's lawyers

This is not a lawsuit. Eric's lawyers have nothing to do with this. This is purely a judicial decision. Eric might not even have to show up because the police were called on multiple occasions and they have the reports.

It does boil down to what was done, but they aren't going to throw the book at him because he's clearly just a gay fat retard and they don't want to tie up too many resources based on him being a public nuisance regardless of who said what.
They'll tell him to stop being a retard, he'll say "I sure will, your honor" and walk out with a fine. He may or may not prolong this through sperging based upon what Juju desires, however.

You need to add the fact that he also showed up to his Grandfathers grave and threatended to piss on it. I think he ended up just dumping grass on it though.
Someone else did piss on it, but it was not Riley. I felt this should be mentioned. I can't imagine Riley wants to drag this crap out in any capacity regardless, because it would mean he'd recieve no attention in jail, and Dick would just move on to another fat loser to pretend to edit his garbage. If the offer's reasonable he'll probably alford plea and it'll just be a suspended sentence or a couple weeks in jail plus probation.

Despite all this, it's still a funny L if just because Null archived the body cam for the incident, and Riley will never live down what a flaccid little shit-stirrer he is.

Is this really relevant to the legal case? The purpose of this thread is solely for the legal case. I will defer to moderator review, but I maintain until then that narrow tailoring is best.

As previously mentioned, the backstory on this is convoluted and long. It would, IMO, be better to keep this thread to one topic and the larger backstory to be added to a Riley thread (if one gets made) or someone re-writing Eric July's a-loggy locked thread. I admit that having it spread across CG and Dax (a.k.a. Juju the Cow, the man who likes to dress up as a cow and get fucked in the arse) is less than ideal, but cluttering a legal thread with the whole burden of the tale is worse a fate.

capping off his response with a claim that by returning at night, Riley could legally be shot in Texas in self-defense.
What a missed opportunity that was.
The real mistake was threatening this action instead of keeping it in pocket, because now it could be interpreted as pre meditation to shoot him (regardless if warranted or not).

To those thinking why doesn't he just pay the fine or settle etc, remember that Riley doesn't make sense. This could have been over but the Juju/Vedo/Riley/Piss Salad crew thinks it is hilarious to take jokes way too far. Like years after things stop being funny. Purposely he made this go to trial to make it go on longer and cause more grief. Eric July is a guy who takes his shit seriously and won't cave in to what he percieves as nonsense. There is potential for him to get the max penalty but I don't think that it will be much for tresspassing or whatever but he's pushing his luck and next time will be a third strike.

Eric was stupid and playing internet tough guy. He seems to have learned the lesson in this case that faffing about on the internet in slapfights with broke retards can get expensive and is dumb because they have nothing to take, but thrive on the attention. It is that old saying about wrestling a pig--you end up dirty and the pig likes it.

Just to clarify, Eric has ZERO influence on how long this goes. This is NOT a lawsuit. This is the state of Texas bringing the charges. Riley could have plead out to a lesser crime, more likely than not, with a restraining order prohibiting him from engaging with Eric or his business, but you are correct that he and Juju want to prolong this. It is not as if Riley has a clean record that he s trying to protect, but he is taking orders from Juju who is gassing him up about how much clout he will get from this.

I know, but someone had to press charges or call the police originally. He wasn't going to just let this happen. Also Eric could be called as a witness but I doubt the state needs more than Riley's own videos of his crimes and the police body cams where Riley is running his mouth. (You might want to add these videos showing the crimes to the OP?)

Why are they not charging Mint for not identifying herself to the cops, lying about her name?

They didn't charge her for anything, probably only arresting Riley because he was being a big problem. Hell, they could've arrested Drunk Drake on public intoxication if they wanted.

The bodycam videos? Rumble archives are linked already already.

Lawyers aren't cheap. Juju had to burn through 30 grand to get the Maddox lolsuit dismissed. Refusing any plea deal and demanding a full trial is not a good move if you like having money.
