Minnesota has 'non-judicial foreclosure' which means a lender does not need a court to begin the process. And that notice is merely the first stage in the process. In MN, the lender files with the county before they tell the home owner and based on the sale date wouldn't have to have tell Nick until 4 weeks before the sale. In this case Jan 10. He probably has little to no idea this is happening. The process can be stalled at any time by filing a loss mitigation application, by paying the defaulted amount (becoming current with payments) or by paying the entire note. You can also bring the process into the courts. It is extremely unlikely that a sale on the courthouse steps will happen.

What I fail to understand is how, 4 months after the Rittnhouse trial where Nick made a million dollars, he needed to borrow $300K. What was it for? They had to have plenty of money both lying around and coming in.

In the end, this could simply that one payment was missed and hasn't been cured for 120 days. I don't know the closing date on the Baldo Bunker, but I wouldn't be surprised if that money isn't used to totally pay off this mortgage and is probably why they put the place on the market at all. No matter how much is in default, it is not difficult to put an end to the foreclosure process. If Nick is learning about the scheduled sale of his home from the Kiwi Farms, which is pretty likely IMHO, well that is *chef's kiss*.
