As a legal matter, I believe you are incorrect. There are many examples of kids, once adults, suing trustees for mismanaging their money. This has happened in some high-profile Hollywood cases.

Those are cases where the child earned the money. Not gifts given to them by the parents. Imagine the legal nightmare of children suing their parents because they believed their inheritance should be higher.

Yes. A parole officer could do this and the way to enforce it would be randomly showing up at his cardboard box under the bridge to make him pee in a cup.

Here's how this would work in the UK. I'd be surprised if the US was different.

You get arrested. You get charged. You get offered a plea deal in which your choice is probation or going to jail. Abstaining from drugs or alcohol might be a condition of your probation. You don't have to take the probation offer. You can go to jail. When you come out again, you can go back to drinking and drugging.

Alternatively, you turn down the probation and get 12 months in jail. Prison offers to let you out early on parole. No drinking or drugging is a condition of your parole. You can turn down the parole and serve your full sentence. (Which would only be six months on a 12 month sentence.) You come out, and go straight back to drinking and drugging.

In reality, nobody gives much of a fuck anyway. Everyone has caseloads that are far too big, so even if such conditions exist, nobody observes them. You're probably never seeing your probation/parole officer more than once unless you're a serial killer or baby rapist.

If you struggle to find a way to make ends meet while holding a law degree (that you didn't pay for yourself) and receiving nearly unlimited financial support from your family well into adulthood, I don't think you can point to 'the system'. The fact that what he considers a good opportunity is drinking on camera 8 hours a day really says it all.

He might have had completely unsupervised probation, no testing, no nothing, and the only time he'd even see his PO would be the first intake meeting. Even most "supervised" probation for minor drug cases is so lax it might as well be unsupervised.

As it is, I think it's a lot more likely he gets some actual conviction and actually have the PO up his ass on a regular basis, especially with his total refusal to take responsibility and kids involved. Even if the cops aren't up his ass, KCDHS will be.

I think you are wrong. As beneficiaries of a *registered* Trust, they could file an action against the Trustees for mismanagement. I believe the law does (or would) recognize that Trustees are liable for their actions, and the relationship the Trustees have to the beneficiaries is not legally important.

Also, I don't think a bank issued the mortgage, but an investment firm in Texas...
it's an investment advisory firm in Minneapolis.

I have to admit it. This is a very good point and it could be why he escapes from alcohol testing. I think he should emphasize this point in his case. It's good if I want to make more money, but I routinely tell people all their doing is wasting money if they are pushing for a motion that is meritless or will certainly fail. And I look at making sure they retain as much of their cash as possible, as a major goal, especially if they're trying to rebuild their life after a case.


The only things I can think of are
1.he thinks being as difficult as possible will make the prosecutor back down and offer a more favorable plea to get it over with
2.he is delusional and wants to fight to the bitter end
3.he is not delusional, but wants to fight to the bitter end because he thinks that will be better for his career?
1. It's not that difficult to respond to the accumulated gibberish the Dream Team has submitted so far. It's just time consuming. I had to help deal with a sovereign citizen when I was an assistant prosecutor and while it was annoying to handle, we knocked things out pretty quick and got back to work on other things.

Damn, I didn't know both Nick and Kayla had millionaires for parents, with Kayla coming from an especially mega rich family. Makes me wonder how a guy like Nick was able to sweep her up when she was still young and full of options.

Anyway, it seem if both their parents are so wealthy then it's pretty much impossible that this story ends with Nick financially ruined. The worst that can happen to him is that he is made to live off a broad allowance waiting for his or Kayla's parents to die so he can be rich again. It's actually incredible to me how Nick can have a million safetynets and golden parachutes laid out for him and still be such a hopeless fucking disaster. Literally every problem he has is self-done. He could unplug from the internet, live off his mother-in-laws teet and live comfortable not lifting a finger till the day he dies.

If he wanted to live like a degenerate with a second wife, swinging and doing drugs he could've done so in private with the insane amount of money he's leeching from his and Kayla's parents. I genuinely don't understand how he let it come to this point.
