How can he even introduce any evidence at this point? He has no witnesses and no possible evidence he could present is self-authenticating. Generally if you're going to introduce documents as evidence, some witness has to authenticate them as actually being what they purport to be.

All the judge knows is at the time of filing, over four years ago, Greer qualified for IFP. He knows that Greer claimed temporary homelessness in the summer of 2024. He knows that Greer was capable of engaging counsel for the 10th Circuit Appeal.

In recent evidence, Greer has supplied a residential address, and has repeatedly banged on about his JOB and working hours hampering his availability to meet and confer. He has refused escrow. It's also been accepted into evidence that Greer is a qualified paralegal of some years standing. At no point since inception of IFP has Greer been required to confirm his current employment/financials.

So as far as the judge knows, he has an income which could be garnished. We are here.

His income or assets are pretty irrelevant as to whether sanctions should be imposed, although it might have some relevance to how much they should be, at least to the extent the sanctions are punitive as compared to compensatory.

So far as I can tell, this is a pure quantum meruit analysis, though, not strictly punitive sanctions, i.e. Russhole's recalcitrant conduct has accrued the entitlement to reasonable legal fees for the work done. His ability to pay is not strictly relevant unless Hardin specifically requests punitive sanctions in excess of the work he's done. This would probably not be proper at this time, although it might be in a post-judgment motion for sanctions for frivolous and duplicative litigation. (So far as I know, Hardin hasn't sent a Rule 11 letter so it would have to be statutory under something like 28 U.S.C. § 1927.)

If the judge adjusts the award to account for Greer's income he will use much lower numbers than those unless there is some exception for self-inflicted financial troubles.
