I was informed in the US Politics thread that this interpretation came to in 1982 from Plyler v. Doe and how they interpreted jurisdiction and the anchor babies were a side effect. Whether that actually amounts to anything to come or not, I have no idea.

United States v. Wong Kim Ark from 1898 is pretty long-standing precedent. It held that 'jurisdiction' in this case applied to anyone other than foreign dignitaries who were instead subject to diplomatic immunity. Anyone else, even those who were temporarily in the US, were considered to be subject to jurisdiction.

The modern autism wrangling mostly comes down to whether or not illegal immigrants can be considered subject to jurisdiction. Doe seems to indicate that they are, but it's a fairly recent decision that the court might have a bone to pick with. Indians usually come here legally on work visas and so it would seem more likely that Wong Kim Ark would apply to them (the parents of Wong Kim Ark were themselves lawful Chinese migrants who came to the US legally before the Asian exclusion acts).

However, whatever does happen, the mere existence of this EO has spooked a significant chunk of the Indians and this is probably a good thing overall even if it doesn't end up shaking out in the courts.

Try 1898, not the 1980s. Going to be very tough to argue against the black letter of the amendment itself. It doesn't leave much wiggle room at all.

There would absolutely be enough support to amend the 14th to remove jus soli however.
