At least the public defender would have a license to practice law, experience with criminal cases, and probably not be detested and despised by every local judge and prosecutor.

I think you'd be better off going into court alone and leaning over to the prosecutor to ask "What do you think I should do?"
 
Anyone know how long normal probations are and if he can get slapped with a 'no drinking' on top of the no drugs? He'd kill himself without booze.

I don't see how he possibly survives a few years of probation with regular drug tests without frying his brain on galaxy gas or popping hot.
If he's on UAs its likely that he'll be assessed to have a drinking problem and they'll ask for no drinking as a term of probatoin

A felony DJ/Diversion is typically 18-24 months.

It is a perfectly normal deal and I think CPS knows more about the situation with the kids and if it has improved since their intervention than anyone on this forum (unless we got some close family lurking).

The first attempt will always be to "fix the parents". Taking the children away permanently is the last resort.

It'll still be hell on him unlike it would be with a normal person because he's going to have to do what the government tells him. He's going to have to lick the jackboots and he's going to hate that. Either he does and suffers or he doesn't and then things get fun again.

The Montagraph suit has some fun possibilities too. It's likely he'll be found to be a limited purpose public figure. This will make it harder to prove because the actual malice standard will apply, but if he does win, it will almost certainly be considered an intentional tort, which is to say nondischargeable in bankruptcy, and there will be a Pay Monty arc.

Legally he got away with everything.

His reputation's still in the fucking dirt and he's got nobody to blame but himself. The only way he can hope to rebuild that is by going to rehab and getting clean. But that means he has has to put down the Galaxy Gas and admit he's got a problem, neither of which are things he's going to do any time soon.
 
It would seem that success in court is directly proportional to the reproductive success of the defendant. Rackets (5 kids) and Gunt (2 kids) both got off pretty much scot free given the severity of their crimes. It is no wonder Null has been significantly less "fortunate" in his dealings with the legal system.
Do you mean Null needs to do drugs or have kids?
 
Its very important that people understand that Nick has not 'legally gotten away with everything'

If he can be the government's good little boy for 2 years he'll have no felony conviction and have 'gotten away with everything'

But he does in fact have to be the government's good little boy, and that means he is going to be randomly pissing in a cup for the next 2 years, and if he fucks up, he will have a felony conviction.

One thing you left out: Nick's 5 kids:
  • They were wrenched from their home for 7 weeks and questioned by CPS.
  • His eldest was offered up as someone who could observe and report on any concerning behaviors.
  • His children still attend the Church that reported him. The grandparents take them.
  • Lastly, the grandfather (Dan Sletta) who housed the kids for 7 weeks, hates Nick.
Nick will have "probation officers" under his roof. One of them will be an adult in short order.

The level of scrutiny Nick will be under is no small thing.
From what it sounds like the continued church attendance isn't some arbitrary thing, and from those few public videos we've seen that the church have posted the kids really love attending and love the community there. The community loves them too.

I'm sure their devotion to their faith and knowing their parents have actively committed many sins may not sit right with them. The question is will they forgive their parents or will they hold some resentment?

I've known some children of addicts to keep quiet about drugs because they were afraid of the consequences of ratting their parents out even if the parents treated the kid like shit because some kids still seek that parental bond, they haven't been burned enough to the point where they'd act on what they see.

Some kids forgive it because they carry the burden of thinking they can fix their parents without anyone's help....and when the parent chooses their vice over their child, the child directly assumes it was something that they did.

I'm worried about those kids, man. I know what sort of personal hell children of addicts go through and that's before you add a polycule to the mix.

Anyway knowing Nick he will probably be in jail in no time knowing his rampant drug addiction and constant downward spiral. Just gotta give him enough time to continue imploding
I hope Austin gets clean and becomes a rehab therapist. Legitimately if he could possibly get his life in control he would be someone who could help others.

Nick will never get better. His wealth and privilege is its own prison.
 
I'm probably not saying anything that hasn't already been said, but -
Possession in the 3rd degree seems very lenient. This is a good deal for Nick.
In a way, I'm actually happy for him (and Kayla).
I hope he's able to keep his shit together and he returns to sense of normalcy - for his families sake.
What's the likelihood of that happening? No fucking idea.
But if he's off the booze and booger sugar, that seems like it would be 90% of the battle.
 
I don't claim to be fully in the loop but did he have the prosecution and judge's family over a pool of sharks?

I'm not a zealot demanding jail time I'm just incredibly confused.

This is a fairly standard deal for first-time offenders, per other practising lawyers on YT. They suspend the prosecution before they 'officially' enter a record of his guilt, and as long as he follows the deals provisions, they never make it part of the record and it simply expires. He is not guilty until they officially find him so and make it part of the record.

In more graphic terms, they made the agreement for Nick to basically hand them a loaded gun hold it to his head until they are satisfied that he has done his part.

The plea deal really is a Rekeita W, which makes it all the funnier that so much pressure had to applied just to get him to take it.

How much better could it really have gotten? They drop misdemeanours and a grade off the top charge.

I think I heard Nate or Kurt say that 2nd degree possession was not eligible for diversion, but I am not sure. It does not sound like much of a win unless the State had to be browbeaten into letting the women get off? I would speculate that the only real improvement would have been letting the women go if Nick took responsibility and he dithered for months about actually doing that to get the basic deal they offer everyone. This is just speculation, but I would believe Nick would make the routine process a pain and half.
