Very true and they both did again yesterday. The issue being they need to officially testify to it as well, as Aaron has a right to confront his accusers. So considering it is "Imperative" they attend, the state seems to have a big problem if they don't.
If Geno was smart he would already have a lawyer. He isn't though. If he was smart he would also stop talking about it. He isn't though.
In reality, playing the odds, what will happen if they don't show is one of three things.
1. The prosecution goes ahead with trial anyway and they both will likely eat a fine of the prosecutor is feeling in the mood.
2. The case gets thrown out and they both probably get a fine of the prosecutor is in the mood.
3. The trial is rescheduled. They both get a fine and get summoned to court (no arrest warrant)to be told if they don't attend the next one, they face a criminal contempt charge.
How likely is the Judge to reschedule? No idea.
The big issue is this is a two day trial and there is no escalation matrix they can get through in order to force them to show if they miss the first day.
I'd imagine common sense is going to prevail and Aaron ends up pleading to the misdemeanor. The prosecutor isn't dumb and no doubt realised there is a real risk they no show and unless it's like Rekieta claims and they have all kinds of awesome evidence, in which case they wouldn't have resorted to the material imperative witness stuff to begin with.
Although their testimony will land Aaron a conviction, there is going to need to be truly smoking gun evidence for that felony, especially when Geno starts babbling about how Rekieta asked him to lie. He didn't say what about yet, but you can be sure Aaron's lawyer will ask.
Here is the kicker. Aaron's lawyer is allowed to contact Geno and Keanu in advance and essentially interview them about the facts as they see it. Aaron's lawyer then needs to turn that over to the prosecution. The prosecution then gets to see what other stuff is going to come in when Aaron's lawyer examines them.
Rekieta should know all of this, even being a shitty lawyer. So why he sits in Keanu's chat and threatens to release their text messages is anyone's guess. Most likely because he has so far got away with it.
All in all, I think there is a very low chance this gets to trial.
