A federal judge Thursday refused a group of government employee unions’ request to block the Trump administration from moving ahead with plans to dramatically reduce the federal workforce.

U.S. District Judge Christopher Cooper ruled that federal law mandates the unions bring their challenge before the Federal Labor Relations Authority (FLRA), which adjudicates labor relations within the federal bureaucracy, rather than a federal district court.

The decision notches another victory for Trump’s Justice Department, which is defending against dozens of lawsuits challenging a broad range of the president’s executive actions, including the administration’s efforts to slash spending and reshape government agencies.

“The first month of President Trump’s second administration has been defined by an onslaught of executive actions that have caused, some say by design, disruption and even chaos in widespread quarters of American society,” wrote Cooper, an appointee of former President Obama.

“Affected citizens and their advocates have challenged many of these actions on an emergency basis in this Court and others across the country,” he continued. “Certain of the President’s actions have been temporarily halted; others have been permitted to proceed, at least for the time being. These mixed results should surprise no one.”

The unions’ lawsuit challenged mass terminations of probationary employees, the administration’s plans for additional mass layoffs, known as a reduction in force (RIF), and its offer for most federal employees to accept a buyout.

Another federal judge previously rejected an attempt to block the buyouts in a separate lawsuit, but litigation against the probationary employee firings remains ongoing after a coalition of unions filed yet another lawsuit Thursday.

The case at hand was brought by the National Treasury Employees Union (NTEU), the National Federation of Federal Employees, the International Association of Machinists and Aerospace Workers, the International Federation of Professional & Technical Engineers and United Auto Workers.

The unions argued that the administration’s plans violates the separation of powers and regulations for how the federal government can carry out RIFs.

Cooper took no position on those issues, instead ruling that the unions brought their challenge in the wrong forum.

“The Court acknowledges that district court review of these sweeping executive actions may be more expedient. But NTEU provides no reason why it could not seek relief from the FLRA on behalf of a class of plaintiffs and admits that it would ask other agencies to follow an administrative judge’s ruling in its favor,” Cooper wrote.
It's fucking hilarious that the judge told these punks to go to the FLRA, which is a Democratic darling body created by Tip O'Neill and Jimmy Carter.

how? how in the name of god does it violate separation of powers? they're employees of the executive branch. he is the supreme leader of the executive branch.

There's a third option, working for the Feds (particularly the DoD) or state and county.
Let's just say I've been very busy at work the past few weeks, and there is so much first-hand salt I wish I could share with you people, but it would constitute a massive PL. Suffice to say, my position isn't in danger (though the lateral change I was applying for is likely kaput). If I did end up fired, well, I'd just back to the private sector. No big. Gotten shitcanned before. Like I said, though, I'm not too worried because I'm not a Feddie, just where I work is basically kept alive by Fed monies, and every single paper pusher here would have to be fired before I get fired.

Government jobs went to shit the second it was made illegal to do IQ Tests/Test in general. Before a Government job was actually a high status thing cause in the 50s they would usually get bright up and comers, figure out they weren't idiots and then have them do something useful.

Like grab a fresh out of college kid with a engineering degree, say "Hey, you seem pretty smart, figure out how to get electricity to this bumfuck no where valley in Kentucky. " After the test became illegals it slowly became a make work program.

This is what makes all the Trump stuff so delicious, enough that I literally clench my fists, close my eyes, and waggle my chiseled thighs (never skip leg day) with childish delight: the only reason Trump is able to do any of this shit that he is doing is because the Democrats created this federal Leviathan. The scuttlebutt I've heard is that, in his first term, Trump did not want to exercise so much federal authority because he didn't know how it worked, he was clumsy, and he believed the bureaucrats around him who later undermined him. Now, after making key allies and educating himself, he's making the Democrats find out after fucking around with the federal government for decades.

The chief concern I've been hearing from my sources is that Trump knows how to use instruments of federal power this time around and he is not afraid to use them.

If President Donald Trump’s border czar, Tom Homan, thought he could intimidate Rep. Alexandria Ocasio-Cortez, D-N.Y., for holding a “Know Your Rights” webinar for her constituents, he picked the wrong Latina.

In multiple media appearances, Homan insulted her intelligence, mocked her credentials and claimed she was undermining law enforcement. And he said he was “working with the Department of Justice” to see whether the congresswoman was “crossing the line.”

Ocasio-Cortez did not back down. “This is why you fight these cowards. The moment you stand up to them, they crumble,” Ocasio-Cortez wrote on social media Monday.

That evening, Homan confirmed he had spoken to the Justice Department about investigating her. But Ocasio-Cortez, unsurprisingly, is undeterred.

“In clear scenarios such as these, the best way to handle paper tigers is to call their bluff.”

“The Trump administration understands that it does not have absolute power and that it must rely on creating a false illusion of power to create a chilling effect to get everyday people to respond to fear, comply in advance, and censor their own free speech. Ultimately, in clear scenarios such as these, the best way to handle paper tigers is to call their bluff,” Ocasio-Cortez said Wednesday in written responses to my questions about the Trump administration and Homan’s tactics.

Homan “can baselessly threaten duly elected legislators with jail and throw around schoolyard taunts all he wants. The very fact that he is tripling down publicly is because he knows he has nothing else,” she added.

No matter how many times Homan goes on television, immigrants have rights protected by the Constitution. His latest obsession with Ocasio-Cortez is a political miscalculation.

With Trump’s anti-immigration machine ramping up its propaganda and actions, fear is spreading among immigrants. That fear is real, and how communities respond will determine whether they thrive in these times. Enter Ocasio-Cortez, with a possible resistance plan that Latinos and immigrant communities have been craving. As she told Latino USA’s Maria Hinojosa this month, “I’m not going to give them my fear.”

“Schools, churches, small businesses, neighbors, families, and everyday people have been clamoring for information and wanting to know what their rights are in the event that they are approached to be searched without a warrant or cause. They want to know what the law does and does not permit, and I am happy to present them with that information,” Ocasio-Cortez told me on Wednesday.

The country’s most prominent Latina politician is doing exactly what needs to be done. With people now impersonating ICE agents, the need for accurate information has never been greater. Politicians need to be there for immigrant communities, even if it means going toe to toe with the Trump administration. Ocasio-Cortez’s grace under pressure is what true community leadership is all about.

This could be the opening Democrats need to re-engage Latinos who have been waiting for someone to stand up.

The November election affirmed that Latinos have been shifting away from Democrats for a while now. Since then, there has been more talk about how Latinos got there and less about how to get them back. Homan’s prominence in the new administration highlights the problems Democrats still face. They are still a “Republican lite” party on immigration, especially when restrictive immigration bills earn Democratic support in both chambers of Congress.

“There is a difference between a party benefitting from Trump backlash and a party that earns enduring support through a proactive agenda,” Ocasio-Cortez told me. “There is absolutely backlash occurring to the Trump administration’s actions, but the recent support among many Democrats of the Laken Riley Act, which guts due process and sets the stage for DREAMers to be deported on the mere accusation of a crime, demonstrates that we have a long way to go.”

The feeling that Democrats still have a “long way to go” is what immigrant communities are worrying about. So far, the mood since January has been deflating and defeatist. Yet if Homan continues to target Ocasio-Cortez, she will just continue to gain more respect and admiration from the communities she is informing and serving. While immigration might not be the issue getting people motivated to vote, seeing Ocasio-Cortez’s fight to call out “the cowards” is a sign of hope. That you can fight and not let others dictate what you should do.

The question is whether other Democrats understand what this moment demands. It is not enough to condemn Republican attacks after the fact. Democrats need to be ahead of the fight, showing immigrant communities that they are not an afterthought. That means challenging dangerous policies before they take hold, calling out anti-immigrant rhetoric as it happens and making it clear that defending basic rights is not up for debate. Enough with trying to out-Republican the message.
