The argument for prosecuting the AI art is that it was trained on CP, which taints the image unlike "drawn" versions which I hope to God didn't use references. So, while I agree there are slippery slopes, I think there's merit to saying that AI CP is CP, and since CP is illegal so is it's derivative.

Yeah I just think that most "reasonable" people would mainly be concerned about the wording in the past few lines in the bill. Intentionally vague (non-transparent) rulings that can be entirely up to interpretation are bound for abuse or extremely inconsistent applications like we've seen with other things.

To get this out of the way, I don't think it should be legal to reference CSAM with AI training because that's technically still possessing and redistributing material with child abuse in it, and CSAM perpetuates legitimate child abuse and increases the market for it. Honestly, I get sketched out when I see people post gore pictures and videos online, so I can imagine how someone who was sexually abused must feel towards photos and videos of a real person being harmed. I still think there's a difference from playing something like Dead Space vs. going on r/WatchPeopleDie. Most people are going on the latter for enjoyment/pleasure, while on the former you can dissociate from anything particularly heavy going on.
