Do I (and most sane people) believe Aaron? Yes. Do we know what exactly he's pleading to? No, we don't. It's rather opaque.

You are right. To get down from a gross misdemeanor to a misdemeanor or petty misdemeanor is going to take some magic.

So what Aaron said may not be accurate, but I'll list some ways it can happen.

1. They refile the charges and charge him with "Attempt". So he could admit to attempting to disseminate an image, but failed to do so. If the prosecution has no witness to say it actually happened, this could be a way.

2. They refile it under Inappropriate use of telecommunications. There is a separate statute for it.

3. Some other charge the prosecutor dreams up.

4. Post conviction motion for revlassification.

You may want to tune up the wording used a little bit. You could quote aaron directly or make it slightly more vague the exact thing he is pleading to.

it is sort of hilarious to imagine some NLO fan who only knows of Nick from the superchats and calls and him going "what's this guy's fucking deal?" like for the first time we actually have a lot of documentation on what leads someone to become one of those insane callers to radio shows.
