I define speech as a near absolute, short of a few specific cases. Like screaming at an angry armed mob to do something criminal or violent with the object of that anger in their reach etc. But restricting it based on fears of nebulous "bad things maybe", or how icky it makes us feel, is not only dangerous, but actively destructive to the very concept of free expression. Criminalizing anything based on victimless actions is usually unjust, and especially so for a right, let alone something as fundamental as speech, expression and imagination. I don't think people are thinking about this clearly, at least not rationally or logically. It's all kneejerk. A dangerous game to play with fundamental freedoms and felony law.

As for the second part. CP isn't illegal because it's morally reprehensible and beyond forgiveness. It's because it represents a literal violation of a child and a severe crime of the highest order.. It's not protected for that reason, it isn't the speech that is illegal, it's the actions that made it. (The supreme court opinion i posted above a few pages spelled it out) A lot of CP possession laws are written with the viewer/possessor in an accessory role to the crime. That's how it's legally justified. People seem to skip past this part or fail to understand when they argue.

They don't need to justify themselves.. That is the literal cornerstone of the way rights work. Everyone else needs to justify with very good reason, why the government and criminal law needs to care. Which on a fundamental level, is all this is about. What does it's "sexual" nature have to do with anything? How would that justify restricting speech? I mean porn is protected speech. But I see people keep bringing it up.

This unintentionally reminded me that the dragonball GT intro has a blink and you miss it goku chode visible in the intro.
