I think Trump is running out of odd things to do that will appeal to his base. The man has decided to try and deliver everything he promised in his first month. Sure that's cool and all, but there needs to be a bit more moderation here. He's going too fast and his support is going to burn out if he doesn't consistently deliver results year after year. There's nothing to reverse a presidential pardon. As written, Article II is exceedingly clear, that the pardon authority is unassailable and absolute. The only thing that would make it stick is a smoking gun proving, without a doubt, that the pardons never actually took place. We would need the Nixon Watergate tapes 2.0 for that, which is possible, but almost certainly this won't hold water.

Yeah, I don't know what to make of this. This is most certainly a really weird and frankly stupid decision to make.

Again, the presidential pardon is unassailable and absolute. It is one of the most important powers the President has. No court is going to uphold a challenge to codified Article II authority because it would be a disaster. I'm telling you, you don't want to establish some gotcha rule about pardons, because what's the first thing the next Democrat is going to do? Go after J6 protesters using whatever loopholes are carved out. It's a slippery slope and thoroughly undesirable.

I honestly don't believe that a cognitively alert Biden would have done something as insane as sign pre-pardons for key personnel. That sounds much more like the kind of people who would lie about the president having dementia for 4 years.

Say if Musk pressed the auto pin button while Trump is doing watersports on Russian Hookers, they might want to ask questions. I would think the smoking gun would be a tape of Biden saying something like "What? I didn't pardon <names>. Now get me my ice cream, I've gotta go to the inauguration." Anything less than such a tape and even if other evidence may imply that he obviously didn't pardon anyone, it's not definitive enough to even glance at. You'll get the defense that such a tape was from before the day the pardons came out, if he doesn't specify the day. You'll have people excluded if he doesn't specify names. Etc.

And if such a tape doesn't exist but they have staffers bragging or logs discussing going around the Big Guy to pardon people, all Biden has to do is go on camera and mumble "I did pardon, umh, those people..."
