Which is around 14.85 million dollars short of her settlement offer. Thus my point. Her settlement demand is many times greater then the possible statutory liability. There is no incentive for Destiny to not take this to trial and lose anyway. Because losing at trial will cost around 14+ million dollars less then just settling.

If you strip away all the legal jargon, Destiny’s actual defense boils down to:

Yes, in so far as the case is in a Florida district where the subject is a Florida resident. Federal civil procedure is used for the mediation of interstate disputes and Federal torts, but the operative laws and remedies of the State itself are persuasive on the court so long as they don't conflict with federal law.

Which basically means the Federal Court could ignore Florida's civil remedies code. But it usually (never) does. Basically, when it comes time to apply what is "just" punitive damages, the fact that Florida caps it at 3 times the actual damages means the Federal Court in Florida will also follow that guideline. Not necessarily. Whether or not there are co-defendants, Pxie and her lawyers need to establish proximate cause to what Steven did resulting in her injury. If they can establish that Steven's actions had proximate cause to the result, then Steven is still liable to some point.

Possible co-defendants can come up when dividing up responsibility. Like if Steven was just 50% responsible, Rose was 15% responsible, Solo was 35% responsible. To make it easy, say the jury thinks Pxie deserves $10 million. That means Steven only has to pay $5 million if they believe Steven is only 50% responsible.

However, one argument is that Steven is so negligent that since even he has no idea who the fuck Rose really is, he should be 100% responsible anyway. If Steven's lawyers start arguing in front of a jury that the real people responsible are mystery people they can even name, it'll probably look worse for him.
