I would just like to point that it's now Wednesday morning in the USA. Thursday night, tomorrow night, Nick Rekeita will be in Las Vegas, looking forward to being in the company of known drug users. Judging by his erratic conduct yesterday/Tuesday, I'm sure there is no risk of Nick succumbing to the overwhelming temptation of illicit sweet delights.

He said he had cleared with the authorities, I believe it was part of the negotiation around the time of the sentencing.

Yeah, Kurt struck clip channels uploading this. Back when there were a lot of ‘Lawtube’ clippers. This random guy in particular made a video about it, because Kurt struck his upload of it. I tried to find it again but with the absolute state of YouTube and search engines right now, it just shows Kurt’s channels and zero results referencing the dating video. It definitely happened though.

I think Rekieta is likely leaving himself liable with the SuperTips situation. This isn't even complicated.

Even Melton put in the terms you need permission. The reason for that was to try and pay lip service to the right of publicity laws.

Firstly, it isn't immediately "blatantly obvious" this is parody. YouTube Superchats display names and messages, making it quite likely this can be confusing to people.

Secondly, the content can be pretty much anything.

Thirdly, this is for commercial use. Rekieta is making money from this.

The Parody argument? Weak. It's clearly commercial, it isn't obvious that it is satirical and it suggests endorsement or affiliation to a normal person, ESPECIALLY when you consider how YouTube Superchats work.

If you think of Southpark, for example, it is very clearly exaggerated, absurd and meant to mock or comment on public figures or situations. There is no liklihood of anyone really thinking the celebrities portrayed (poorly) have endorsed it or participated. There is also the fact it isn't directly a commercial use of likeness, which the Supertips obviously is.

Nick really is terrible at all things law. Anyone prepared to do a little research can see just how wrong he is.

As for Melton, his whole platform is clearly now dead in the water, as nobody is realistically going to consent.

It’s extremely easy to get prescription stimulants online these days. Sites like Klarity exist where you sign up, pay a $50 fee, then you meet with a nurse practitioner who just asks like 5 questions before giving you the prescription. I know a LOT of people who get adderall this way, this is actually how a lot of esports players and fighting game people get their adderall(if you didn’t know, basically every esports player is on adderall when they play).

Wouldn't the parody defense in this particular case refer to people writing the superchats anyway? They are writing the allegedly parodist content of supertips ('Am Kurt, Am FAT'). Pedofriends of Nick deliver a voice model - which itself can be used for any purpose, parody or otherwise.
