Discovery of restraining order:
Hardin clarifies how Russ lied about restraining order and not supplied anything
Russ says he told Hardin on the phone he'd try to get it

Russ claims his claiming there was a restraining order was "error typing on his phone"
Judge asks why Russ has no access to his own documents, says Russ hasn't been trying very hard, he can just get it.
"Concerning" to the Judge. Doesn't understand why he hasn't.
Russ thought that Hardin was getting the document himself, claims he wasn't told by Hardin.
"Mr Greer he filed a motion to compel"
Russ: "Forgot to reply to it".
Judge: "But he sent you a motion so he told you"
Russ: "Sorry, but it has no relevance to this case. I've been stalked (?)."
Judge: Can't say it's not relevant because you didn't reply.
Judge thought he'd done it, extreme brow furrowing. Not acceptable. Ordered to supply within 14 days. Told to mark Confidential.
Judge tells confidential stuff not to show up on the farms or the Holy Armies of Justice will come for you.
Status report on this within 21 days from Hardin, can discuss fees then. Not just fees, rule 37b sanctions (case termination).
Hardin: Russ is lying about anything he's saying about confers.
ECF 234, Rule 11 sanctions:
Hardin describes how Russ referred to dead man Steve as eager to testify despite being dead.
Russ: "I listed every person I talked to. I should've made sure he was still interested and STILL ALIVE. I had no idea."
Hardin: Objectively bullshit to say someone is eager when they're dead and you haven't spoken to them. Should be sanctions.
Judge: What's the prejudice exactly?
Hardin: We went back to Utah partially so Dead Steve could testify. Hardin explains the other 2 witnesses and subpoenas.
Russ claimed he had REAL (in caps) other witnesses. In the end he has nothing. Hardin thought he was hiding Steve, was trying to track him down. Russ claimed they had a falling out, Hardin wants to talk to him more. Finally Russ says Steve is dead.
"This plaintiff just files things, he just pops off".
Russ: "Mr Hardin will latch on to individual words and not focus on the entire argument." No prejudice because Null hasn't lived in Florida for a long time. Rumors that he's living abroad.
About Steve, "I misspoke ... I was unaware that he was dead". Dad and brother said they would testify, but when he talked to them again they had nothing to offer.
He bitched at his brother about how he looks like a liar now.
Judge: Will issue a written order on it. Hardin: What should that sanction be and why?
Hardin: Minimum: Attorneys fees pertaining to Steve. I think there should be more because now we're back in Utah. Null resides in Florida, is on the record.
Hardin thinks termination is needed. No witnesses, there's no way for this case to go.
Russ: I have written evidence that Null is living overseas. He has been stalking me for 8 years, but I can't do anything because I don't know where he lives.
It's in Utah because I was living in Utah. I admit I'm pro se and I messed up a bunch of stuff, but it's not unwinnable.
"I have photographs of Null posting my copyrights (and others) online."
Judge: We have to follow the law. When you say things they have to be right, and you need to investigate appropriately. I will take it under advisement and issue an order on if there's a violation and the appropriate sanctions.
ECF 235, Motion to Stay Discovery:
Judge: No response was filed. I want to grant it. Not until the defendants are filed, but until motion to dismiss is ruled upon.
Hardin: That was one of our alternatives. But neither of these new defendants (Russtard and Moseph Jartelli) were disclosed before, so discovery is misplaced.
Would like a broader stay but I'm okay with this.
Russ: The reason I didn't respond is that I don't oppose that. But it's not true that they don't have discoverable info. One of them directly infringed my copyright. "Russtard" was conspiring to infringe.
I don't know how to serve them.
Hardin: He just said he disclosed everyone he could think of. Now he says he never disclosed these guys despite being super important. Wildly inappropriate. He is confessing to a rule 26 violation.
Judge: He can amend and add parties.
Hardin: He was required to state who has discoverable information in this case. No new facts have lead to this, now he says he needs them. He never said Null has any discoverable information either.
Saying that he's doing it for purposes of service is not it. Statute of limitations would have expired too.
Judge: Rule 26e says you don't need to disclose if it is known to the other side. So Russ doesn't need to disclose them.
Hardin: That's fine because this is a motion to stay discovery. I think this is part of bigger problems but we don't need to discuss them now.
ECF 251, Bonded Stay of payment for sanctions:
Judge: Refers to a final judgment, not in the middle of a case. Rule 62b does not apply to this situation at all. Russ can ask Judge Barlow to stay the payment if he wants to, I can't rule on that because my daddy stepped in and ordered it.
I want to deny this but you can ask Barlow.
Russ: Yes I understand.
ECF 253 and 258, In Forma Pauperis stuff:
Judge: If Russ can pay his fees there would be no need for a review (25

Asks Russ if he can pay 402 dollar filing fee.
Russ: "Yes I do." "Hardin focusses on all these little things". Doesn't see how IFP status or no has any relevance to copyright infringement.
Judge: IFP status has to do with whether the Court can hear the case. Cases need to meet a certain threshold. Orders Russ to pay the filing fee (30 days) or will dismiss the case.
Russ: "Yes your Honor."
Judge: Are you able to continue your support (pay your rent etc).
Russ didn't understand and appears quite shocked in general.
