Question: This may have been answered earlier, but at what point does "Excusable Negligence" cross over into the territory of "Malicious Non-compliance" or whatever a more appropriate term would be?
Somewhere along ECF 278 or 273 whichever you prefer. I'm partial to 273 myself.

Especially in mushmouth's case, it's always assumed he's clinically retarded, unless defendant can present an undeniable proof (like a discord message or something like that) that proves malice.

Russ is in a good position here. He can't actually file a motion to dismiss this late in the case without the defendant's approval. But now he has an out, he can just not pay. But I like to think the court would maybe actually approve a ton of monetary sanctions both already filed and likely to be filed by Hardin.
 
The Judge openly realized that this lawsuit has nothing to do with Copyright. With a side helping of he's seemingly started to realize that the Plaintiff is a paranoid nutbag who is seeking vengeance against mean things said on the internet. I cannot see this ending well for Shitlips.
100%. Now that Russhole has been given a chance to explaaaaain, I feel this case may be at a tipping point.
I think even if Greer somehow STILL forgets to mark it correctly, Hardin will not file it as an exhibit. Bennett sounded like he was specifically telling both sides that he does not want to see it posted on Kiwi Farms and if he does it was heavily implied that he will make Josh eat a giant shit sandwich over it. I think he did this as a safety net in case Greer still fucks it up somehow.
Agreed. There is no way the restraining order-related docs will be added to the status update filing, even if/when Greer fucks it up. Hardin's acknowledgement that said documentation exists and that he has sighted them should be good enough for anybody.
Him even having to file a small fee of 50 bucks every time he gets an inkling to do so is probably sufficient to get him to stop with shenanigans.

To add to the joy. The Utah Court or Sheriff's will almost certainly charge a document fee for those Restraining Order documents. Russhole ain't getting him his penis sucked this month!
