People laugh and it is funny to a point, but I've gotten kind of disgusted over this case and what it represents as time goes on.
I enjoyed this case more in the beginning, when it seemed like it was just a matter of time for the Judge to see that Russ is completely retarded and this case should be dismissed. Then that didn't happen repeatedly and it was certainly depressing which is why whenever this case slows down and Josh has to pay less I'm happy even though it is less funny things happening.
The legal systems is extremely broken and there is nothing any of us can do about it.
B: Not opposed to motion to stay. Motion to stay granted until dismiss is adjudicated.
This is a big chunk of legal fees that Null doesn't have to pay.
The court now has the option of dismissing on at least three valid grounds, or could wait for the briefing on the motion to dismiss (itself raising multiple grounds) in order to dismiss it on any or all of them. This would make it virtually unappealable since Russ would then have to win on every single one on appeal.
That was my thought too. This is essentially the court saying that "You have one last chance to do what you are supposed or this is all over"
Also worth mentioning Hardin was not fighting the Judge nearly as much this time and in fact seemed to get along near perfectly. This is a shift from the last hearing where the Judge and Hardin seemed to disagree a bit.
I think there is something in that application that is a major problem for him
He is certainly acting like it. On the other hand it could just be he doesn't want it ending up on the farms because he will be made fun of.
Judge tells confidential stuff not to show up on the farms or the Holy Armies of Justice will come for you.
He could contest it the marking, but that seems silly given that the Judge ordered it.
Hardin has no reason to oppose this honestly because he got what he wanted. Sure it would be nice to be able to laugh at Greer's retarded RO but on the other hand, the SPO does exist for a reason, and it is more important that Null win this case.
Status report on this within 21 days from Hardin, can discuss fees then. Not just fees, rule 37b sanctions (case termination).
Excellent that the judge is possibly allowing case termination as a result of this. It is a way to allow for lesser punishment while leaving the possibility of more severe punishment.
Judge very quickly said "Great! I am ordering you to start paying fees!". The Judge also sounded incredibly happy as he said it. He didn't even wait a millisecond after Greer's answer.
It is such an easy way to resolve IFP status. No looking into financial records, just pay or there will be consequences.
Even when you have an IFP/pro se plaintiff and a pro se defendant, the plaintiff still has the burden of proof, and judges are frankly more likely to be accommodating to pro se defendants than they are to pro se plaintiffs, especially if those defendants aren't obviously acting in bad faith.
The problem is Null can't represent Lolcow LLC, because you have to be a lawyer to do so.
I hope Russ posts the $402 filing fee and then the judge dismisses it on the merits.
This is a pretty good reason to look for an out in this case. Of course Greer rarely makes good correct strategic decisions.
Who claimed to be homeless and broke. For all we know that was one big snowjob by Rusty.
Greer does consider hookers to be part of his basic needs for survival.
