Please don't read this as dismissive, but this has come up a lot and you're better served by reading the earlier posts.

This top (most recent) quote was written after Tony got married to Zac and the situation hasn't changed since then. Presuming she hasn't moved, Kate (Andy's mum) lives in Roanoake VA and she has him at the weekend (perhaps not every weekend as it's a 4-hour drive from Germantown?).

I don't think she has a better shot of getting custody now. No matter her own situation, Tony has been Andy's primary caregiver for at least the last 6 years (of 9), he has (arguably) a stable and flexible work-from-home job, they live in a decent house where Andy has spent almost his entire life, and Tony is again (arguably) in a stable relationship. Plus Andy seems to approve of this situation.

Earlier, I think when Tony was in a polycule with two 20-year-old autistic trans-identified men:

I wrote up the divorce documents that @Marvin very kindly fetched for us last summer, but in short: Tony was the primary caregiver, Kate was the one to leave the family home (leaving Kiddo with Tony), Kate had an unstable work life (long hours then unemployed), Kate had a newborn with her new partner, and had moved several hours away to Virginia (away from Kiddo’s friends and school).

And, last but not least: Kate had previously agreed to something like the arrangement they have now, and then a few weeks later refused to return Kiddo to Tony at the end of a scheduled visit. (She had to be ordered by a court to return Kiddo.)

At the time custody was decided and the divorce finalised, in January 2021, Tony was working full-time but from home, for what used to be ShareBlue. He had been Kiddo's primary caregiver from at least summer 2018.

His ex-wife (second ex-wife!) was unemployed and living several hours away with her new partner and baby and, I must stress, had violated an existing, mutually agreed child custody arrangement and effectively absconded with the child. Judges don't take kindly to people violating agreements!

As far as we know Tony hadn't started dating again. The divorce case took place literally years before Tony's polyamory arc.

I don't want to give the impression of being soft on Tony, but we should avoid reading back what we know about Tony's behaviour now, in 2023 after a year of autistic digging into his past, onto a case that started in summer 2019 and was wrapped up on January 14 2021.
