As seen with Ash’s Charizard, pokemon can change personalities when they evolve. I would almost consider them a new person. They look different, they act different, and they even speak different. It’s kind of like asking if you’re the same person you were at 5 years old when you’re now 35 even though all the cells that made up your body at that age are long dead and you act completely different. Sure it’s still technically you, but you are in essence an entirely different person.
And besides, when a pokemon evolves, do they get entirely new cells? The court might see that as them being someone else.
Tom is also a fucking retard and probably wouldn’t even know it’s potentially the same person.
