At 4:17pm today, the Kandiyohi County Attorney filed a motion asking the judge in Rekieta's criminal case 34-CR-24-341 to "correct Court records to properly reflect that the two body cams were never offered or received as exhibits at the Omnibus hearing", stating that "the import of this issue is significant as under Minn. Stat. 13.82, subd. 7, 'any investigative data presented as evidence in court' shall be public."

It sounds to me that they're saying that the bodycams weren't presented as ebidance so therefore they aren't public records. Which at best means Jersh v Candy Yoshi County
 
Why would he be remotely shook by a traffic ticket? So what? No PO is going to give a shit. And he was already shook before he even took his "drive."

Generally speaking yes, there isn't a PO under the sun that would ever start a full-blown probation violation proceeding over a traffic ticket, but in this particular case there's no need to even lift a finger when the sentencing order's wording makes the jail report date presumptive and the potential deferral is not self-executing on its face.

Thanks to that sloppy drafting, presumably someone would have to take some sort of affirmative step in July to trigger the deferral, which would consist of either 1) the PO filing some sort of brief report or letter request recommending the deferral due to full compliance with all probation terms thus far, or 2) Nick having the Barneswalker file some shitty eleventh-hour motion insisting that some sort of reliance interest makes him entitled to the deferral because um-ackshually there is no record of any probation violation thus far. Even so little as a traffic ticket running afoul of "remain law abiding" would at least knock out any opportunity for #2 to compel anyone to affirmatively change the track he's on, thus leaving it at the PO's unfettered discretion whether to simply refrain from putting 5 minutes of work into #1, twiddle her thumbs, and run out the clock until he has no choice but to report.

Would she really pull such a dick move? Maybe not, but you can never underestimate Nick's prodigious ability to ODD himself into another burned bridge.
