You can submit evidence for various purposes outside of the trial, and the evidence becomes part of the record. And there are plenty of times when evidence is submitted—like at trial—without being particularly raised in testimony or argument. Usually it's when a bunch of evidence that might be used is admitted by stipulation of both parties. So I don't particularly buy the argument that it wasn't made part of the record when it was submitted as part of a pretrial motion. But maybe Minnesota has different rules than the federal system.

What part of this says that "not accepted" into the trial record as evidence means that it can't be accessed? What mechanism is preventing the release at this point?

I don’t know if any potential window where a suggestion might matter may have already closed, but as far as the public interest element of the rekieta footage, I’d state it like this:

1: The actual elements of fraud on rekieta’s part may not be met in a statutory sense, but in the sense of a social contract, he defrauded a large amount of people

2: He continues to perpetuate this fraud by lying about the circumstances of his case. Far be it from tawdry gossip sites, this affects people who donated their money to Nick thinking they were doing good in the world by elevating a humble Christian dad in the media space

3: this is all un-remedied by his conviction. The body camera footage represents an authoritative source of truth, which the public deserves and can’t get from him

4: as far as people not liking Nick, the damage is done and the footage won’t make new converts. It would just be closure

The part where one of those poor kids, clearly terrified, is insisting to the police who have been forced to break down the door of the Rekieta family home that 'daddy told me not to open the door' while he's hidden away nearly had me tearing up. The issue is if the order that i've seen posted here is just to change the status of the material from "received" to "not accepted" that does not mean a judge has stated that the bodycam is sealed/restricted.

Yeah. But there are problems in that they are trying to make that argument retroactively and after another court made a decision about releasing the footage. It has the appearance of an event happening outside the county's control and all the officials in the county scrambling to make up a retroactive legal argument to fix a problem they created themselves.

If they had clearly dealt with the issue at the time of the original legal proceedings, it might have worked. But trying to come back months after the fact saying "ignore what we did it in court.....we really meant to do this" is really shady behavior.
