This has been brought up ad nassium in the past 24 hours: they’ve already demonstrated a disregard for the law. Even if Null wins a noncompliance lawsuit against the county, restitution would merely be monetary, with no repercussions towards the sheriff or prosecutor and the footage still gone.
 
Another funny bit- did Nick's lawyer, Mr White, even need to put the footage into evidence? Obviously it wasn't used. Could this all have been moot if Nick had hired moderately competent counsel?
Nick’s whole contention was that April wasn’t Mirandized. Because presumably he was too occupied whining about probable cause at the time to notice that she in fact was.
So he probably ordered the bodycam be put into the system to epically own the cops, and the lawyer didn’t bother to watch through it all to see that it proved the exact opposite.

That's a big part of this issue here. We had video that was entered into evidence for a criminal trial and now they're claiming it's not evidence anymore. If it's not evidence, retention practices say keep it 90 days (bodycam retention policy linked earlier in the thread). Absent ongoing litigation they'd be free to delete it at this point.

This is an extremely atypical scenario. I have never seen or heard of this happening, ever. Both because usually the justice system is more than happy to let the public see video that 100% vindicates their conduct, and because it's an utterly retarded legal stance.

I would think they'd want to keep it until it's fully settled, in this case his probation is over, so 5 years just in case shit hits the fan and they bring back the charges.
But that doesn't mean anything. They'll still delete it "on accident" if they want.

Nick was moving in the direction of trying to fight with her over who wanted to socialize with who. Its easy to speculate that she has things she could drop on that subject that Nick would not want dropped. Going back a long time, there was secondhand information that they were discussing swinging at one point and that Kayla was involved in the discussions.

It would have taken a significant threat to get Nick to totally back down like this after going so tough at her and picking a fight with her. Nick had been careful in the past to let this sleeping dog of a dispute alone. I'm sure that there are things there he doesn't want coming out.
