Yes, the court can technically, on its own motion, dismiss the case for lack of subject matter jurisdiction, but let's consider how many things would have to swing in Destiny's favor for that to actually happen. The court would have to disregard allegations in the complaint that Destiny sent the Video after the statute's effective date, the court would have to disregard testimony indicating the same thing and which effectively rebutted Destiny's only argument that the court lacks jurisdiction, the magistrate judge would have to recommend dismissing the case even though no party has formally asked the court to do so, and the district court judge would have to agree with that recommendation even though it is already aware of their arguments concerning jurisdiction and scheduled trial anyway. Honestly, the mind-raped denizens of DGG seem to genuinely believe its possible a federal judge looks at this case and thinks "Pxie? She's just a money-grubbing whore, and her witness is Darius's crazy roommate who took pictures of Melina's diary! Pffffft....case dismissed."
So right after Destiny opposes a victim of revenge porn trying to remove her intimate images from the internet (because even if Destiny has deluded himself into thinking she's not a victim of him, she's obviously a victim of somebody), he's floating the idea of retroactively objecting to her proceeding under a pseudonym and compelling her to tie her real identity to the lawsuit and, thus, the Video. I racked my brain trying to think of a reason why this would be legally advantageous for him, and I honestly couldn't think of anything. Its just a blatant attempt to further harm Pxie and potentially intimidate other victims and witnesses from coming forward by suggesting that he is going to fight any attempt for them to remain anonymous. I think we are at the point where his conduct in this lawsuit is arguably significantly more disgusting than his original sin. And people really should not let Erudite and others continuing to stand by him, even at a distance, forget about this. You can't talk about morality and ethics online and refuse to give a clear-eyed condemnation of this sort of conduct from somebody you were so closely affiliated with. By all means, she should continue twerking alongside male youth suicide rates, but she should leave the morality discussions to people who actually care.
I've noticed this line of thinking from DGG a lot, and I can't remember if I've ever commented on it. The American Rule dictates that parties are generally responsible for their own attorney's fees, regardless of who wins or loses the case. The only reason Destiny would potentially be on the hook for attorney's fees is because the statute she is suing him under specifically provides for fee-shifting. I'm genuinely curious what provision of law these morons think Destiny would be entitled to attorney's fees under.
