A quick scan shows a lot of prominent phrases in these proposed jury instructions do not appear anywhere in the instructions for the Fifth.
However, such phrases, like "determining whether the search was unreasonable" and "conscious objective" do occur in the Ninth Circuit's pattern jury instructions:
The text in the early part is mostly consistent with this with the addition of the "or curtilage," presumably because this case also involves that.
I'm surprised the City would agree to this kind of language. Maybe they hate their own pattern jury instructions, which appear to involve an arcane construction procedure instead of just cutting and pasting. I guess my expectations have been lowered by intense exposure to moron litigation, but it's sort of a breath of fresh air to see attorneys actually do their job in a somewhat collegial and professional fashion, tard wrangle their clients, and submit joint filings.
It doesn't improve my outlook on how the case is going to go, because I can see it settling immediately after whatever happens on summary judgment, especially if it's favorable for Fatty.

What are the odds pat ends up using AI to finally finish his fucking Tiny Tim book and just prison stalkers anyone who questions it? I could even see actual authors like GRRM or whoever owns his shit to end up using it to actually end that series because it'll be better than nothing and eventually people will just accept it as we do everything else.
