Ethan could easily get Denims for damages if he counted up her twitch subs and subpeona'd Twitch for her ad revenue that day. Her audience saw such a huge documented boost during the premiere she's a lay up. I can't say the same for other two because I haven't seen their numbers.

Actually Ethan asked Hasan to react to the video so consent was given. It was also more transformative because he spent 9 hours getting through half the fucking video. This is an incorrect statement of Akilah v. Sargon.

Sargon was found to have engaged in fair use because he did actually transform the work by editing it, Sragon's work was also not openly and loudly proclaimed to be a way to essentially, replace the original video in the market, which these streams were. That is a key factor in copyright.

The only situation where this might apply is Hasan, because Ethan spent months badgering Hasan to watch it on stream. Hasan never actually watched the whole thing so didn't meet the arbitrary threshold Ethan identified in these cases, but I do sort of wonder if his lawyer advised him to not pursue Hasan on this one because Ethan had been so pushy about trying to get Hasan to stream it.
I've got a strong suspicion Hasan was the intended target of his trap and the likes of Frogan are just a consolation prize. It would have been pretty funny to see Hasan in court, but that would have come with the downside of giving Ethan Klein some form of satisfaction about scoring a W over the man he's become psychosexually obsessed with.
