A California mom charged in the death of her toddler was getting lip filler injections when she left the child in her car amid temperatures that topped 100 degrees, according to allegations in court records obtained Wednesday.

Maya Hernandez was charged with involuntary manslaughter and two counts of willful cruelty to a child in the death on June 29 of the 1-year-old boy and the hospitalization of a 2-year-old who survived.

Hernandez, 20, has pleaded not guilty, NBC affiliate KGET of Bakersfield reported. She is being held in lieu of $1 million bail.

Court records did not list a lawyer who could speak on her behalf.
A Bakersfield police report said Hernandez “admitted that it was irresponsible to leave her kids in the car, and she thought about it when she got out of the car but had no justification as to why she left them."

The children were left in their car for more than two hours while Hernandez got the cosmetic procedure at a spa in Bakersfield, roughly 110 miles north of Los Angeles, the report says.

The outside temperature reached 101 degrees while she was at the appointment, according to the report, which notes that such heat can raise a vehicle’s internal temperature to 143 degrees.
Hernandez told officers that she left her 2022 Toyota Corolla running with the air conditioning set to 60 degrees, according to the report. She said she gave her kids candy, crackers, milk and a cellphone to watch.

She had asked the nurse who was performing the procedure whether if she could bring her children in, according to the report, and was told she could leave them in the waiting room.

She did not bring the children inside, and she told police that she was "concerned about the time," the report says.
Hernandez said she was certain the vehicle would stay on because she had previously stayed in the car for extended periods, the report says. But authorities learned from a local Toyota shop that the car automatically shuts off after an hour of inactivity.

Hernandez told officers that she did not check on her children between 2 and 4:30 p.m. while she was inside, the report says.
She told officers that when she returned to the car, one of the children was foaming at the mouth and shaking, according to the report. She performed mouth-to-mouth resuscitation and called 911, the report says.

When the boy arrived at a local emergency room, he had an internal temperature of 107 degrees and no signs of life, according to the report. He was pronounced dead shortly before 6 p.m.

The older boy had a temperature of 99 degrees and was able to eat food and drink liquids, the report says. A nurse at the hospital told police that children older than 2 can better regulate their body temperature because they can sweat.
The boy was listed as stable and placed in protective custody, police said in a news release.

Wlliful cruelty, If charged as a felony, the penalty can be imprisonment in a state prison for two, four, or six years, or in a county jail for up to one year, plus a fine of up to $6,000.
 
I was almost sympathetic, when she left the AC on and the car shuts off after an hour (god knows why) , but leaving two infants alone with possibly dirty diapers and no supervision should get her a charge to begin with. Sad it turned out the worst possible way.

Because leaving the AC on without the engine running kills the battery as far as I know.
If the engine was on it shouldn't have. Thats what the alternator is for. If the engine shuts off for any reason it'll drain the battery real quick though. It sounds like the car ran out of gas, battery drained and the AC shut off. Not that the kid should have been left in that situation in the first place

Watch it turn out she used the gas money for her lips, or intended to use it to get her nails done afterwards

Yeah but two things
1. These people who do this always lie about leaving the car running or how long they abandoned the victims.
2. There is no alarm to notify you if the engine dies or the A/C shuts off so you’re really just playing the odds that things will be okay with defenseless children
So, you know, I don’t feel very willing to accept anything she claims. And even if I did the idea of leaving a living being in a place not equipped for leaving babies alone in is so stupid I would rather just have her shot.

I'm assuming this is one of those newfangled modern car technology things? If so, sux, but she was allowed to bring the kids in the waiting room so she absolutely should have. Or better yet, hire a babysitter. If she's spending money on filler, then she has babysitter money as well. Then again, babysitters tend not to take near-maxed credit cards.
 
I'm glad they're charging them, at least.

I'm guessing the car had a stop start battery and that's why it turned off. You only find them in relatively recent model cars, so I assume she's not hurting for money.

Given where she was parked, if the window tint wasn't so dark there's a chance someone might have noticed the kids in the car alone.
 
I guess natural selection still exists in some form. I didn't think we'd sink as far as not leaving your offspring in the equivalent of an oven would be the intelligence floor but here we are. Good to know idiocracy can't be a documentary because eventually californians get too stupid to raise their kids.
 
I just saw body cam footage of two tiny under-5 little kids busted out of a hot car in Georgia. It was 117 degrees inside the car and one who needed a car seat didn’t have one and was wearing long sleeves. Seems we’ll get this demoralizing shit once a week til summer is over. I wonder how often little kids are locked and left alone in a car throughout the rest of the year.

By age 1 I'd expect fully developed sweat glands.
Babies don't start to sweat or cry with tears until they are about four to six months old. Their sweat glands and tear ducts and temperature regulation aren't mature until then. There are any number of articles on the subject for laymen, never mind the medical literature.
