Entering the United States without approval from immigration officers is a crime, specifically a misdemeanor on the first offense, while illegal reentry after deportation is a felony offense.

Also, deportation isn't a legal punishment you stupid fuck, it's a legal process. The due process is a immigration official determining that an immigrant is illegal, and deporting them, they aren't legally entitled to a court case with a "Jury of their peers" specifically because "peers" refers to other Americans.
