How is it fake if the Sam has admitted the photo was him with "a girl who was already famous on 4chan who used to get nosebleeds often". They are both shirtless, the photo was in Sam's old apartment, it all adds up with what she said in 2019 iirc.

How can a girl be raped at 16/17 when she's having consensual legal sex on purpose? How's that work? Just because you don't agree with a state's laws doesn't mean you can make up your own.

You can think it's sick, evil, disgusting, whatever you want to. But it is by legal definition not rape. If it even happened.
