Tom doesn't have to have a registered copyright to claim copyright protection on his original work. He does, however, not get special snowflake protection against defamation from copyright law. Fair use is fair use, even with severe butthurt.

Bottom line is that reproduction for parody, commentary, and non-commercial use is pretty well covered by fair use. Ergo, and video with modifications or captions added for amusement is, by definition, fair use.
