eBay's T&Cs state that a bid, or BIN purchase, is indeed legally binding. I've heard of cases where sellers have taken buyers to court over unpaid items and won. However, that all depends on whether the seller can be bothered or has the resources/knowledge to do so.

I think Rob Bell would be more than happy to take a break from his real job and represent Chris in a lawsuit against da ebay trolls.
 
I really wish he wouldn't have been a dick about the "buy now" price. If he had set it lower ($20) he could have gotten a legit buyer, be it an interested forumer, or an asspatter. Instead we get "Pay me hundreds or I'll send you a crumpled up page!", and now the weens have attacked.
It's sad because selling Sonichu art at a reasonable price could have been something that would have left him with some money to spend. : / The big is over half a grand now, I doubt anyone will really pay.

As an avid eBay user, I just thought I'd throw my two cents in (also first post, Whoo!)

However, that all depends on whether the seller can be bothered or has the resources/knowledge to do so. I will say with 100% certainty that Chris would never take it that far. But, y'know, he could. But Sonichu being a huge copyright infringement might muddy those waters.

I doubt his infringement on Sega/Nintendo would matter overall though, as people sell fan made things on eBay all the time *cough*mlpplushies*cough*

Unless you make an eBay account behind a VPN just to troll Chris. Which, let's be honest, I wouldn't put past some of Chris's weenery.

You are aware there is no legal binding to actually pay the highest bid on eBay. It's not linked to your credit card number or anything like that. You have to manually send whoever the seller is the money, usually though Paypal. Whatever ween "wins" the action is likely just going to fuck off afterwards, never sending OPL a single penny, much less $200+. It's the lowest of low effort trolling.

Eh, I haven't read the ebay TOS, but you likely do incur some contract obligation to pay on auctions you win. The real problem is that damages are so small it's not work the lawsuit.

Everyone talking about copyright and fair use: fair use doesn't go away automatically when you make money off it. Profitability is one part of a multi-factor test for fair use, what's probably more important is if you're taking sales that would go to the copyright owner. the Sonich and Rosechu characters are probably fair use, and even selling pics of them is probably something he could get away with. Chris' real copyright problem comes from the comics, they just lift settings and characters whole cloth from pokemon and sonic with no real justification or cometary on the source material. It's probably permissible as long as he doesn't sell it, but if he sold comics there is a much stronger case that it's taking food out of Nintendo's mouth because they have things that are direct total ripoffs.

I was pretty serious when I said that if Chris sold those little Chaotic Combo figurines, I'd buy them. They're cute and I would instantly become Queen of the Weens. Win/win.

I also said in the same post that I knew Chris would never sell them for five bucks each. He'd want $500, NO HAGGLE, not because he thinks his precious creations are worth it but because Chris wants maximum profit for minimum effort.

TL;DR: Chris is greedy and lazy and he's screwing himself.
 
I hope whatever the outcome is, it doesn't deter Chris from selling his work on eBay. I want an original Chandler, I truly and honestly do.

Even copyright needn't be an issue. I'd pay $100 for a picture of Mayor Chandler fighting a Jerkop - $150 if the Jerkop is tearing his Attraction Sign
 
I just saw the bidding was at over $500. I think some weens are placing fake bids to jack up the price. Is there any protection to the seller on ebay to avoid this.

Now that would be more like it. Instead of saying "this is what I fucking felt like drawing. you guys bid on it." he should be taking commissions.
