So we now have the bylaws of the HOA. And this is what I believe he's in violation of

1. Noise during quiet hours. Quiet hours in that HOA start at 1030. This includes TVs and stereos, but can also include screaming at vidya games.

From the bylaws of the HOA
All occupants shall avoid making unnecessary noise. Using musical instruments, TV's, computers, radios, exercise equipment, and other devices in such manner as may disturb other occupants is prohibited. Owners should make a special effort to reduce noise between the hours of 10:00 p.m. to 8:00 a.m.

Considering Phil is consistently up playing vidya games until 11pm and even before the quiet hours, he's screaming very loudly with only minimal sound dampening foam on his walls. We see in the bylaws that these condos are wood frames, not concrete so sound travels between the units very easily.

Another potential issue.
1. Maintenance. Each owner or occupant must maintain his/her individual patio, driveway and sidewalk to the unit front door in a state of general neatness and cleanliness. A pressure washer is available for loan for removal of dirt, moss and other debris. If the patio is damaged due to an owner’s failure to maintain it, the Board may have the patio cleaned or repaired and the owner will be charged the costs involved.

He recently pressure washed his driveway. Does Phil strike anyone here as someone who actually cleans or takes care of his property? I wonder if the patio was deemed in a state of disrepair or the driveway had cracks or something that the HOA said had to be repaired. Replacing a driveway is VERY expensive and not something Phil would be able to do easily. IMO Phil would never pressure wash his driveway unless forced to.
This also fits in with the "not my fault, not your fault. Nothing money can fix"

There is nothing in the bylaws about not running a business out of your house though, which tells me that conversation he had with his neighbor about noise could have come "after" the noise notice he received. Possibly got a notice saying "there are complaints about the noise coming from your home during quiet hours, as well as your driveway looks like hillbillies live there. Stop the noise and clean your property. For your convenience there is a power washer" So he accosts his neighbor and says "hey can you hear me when I'm yelling at vidya games?" The neighbor, possibly being elderly and not wanting confrontation with a 6' tall 240lb unkempt gorilla, says no they cant hear anything. Phil then informs the condo board that he's power washed the driveway. He receives another notice about the noise and possibly that his driveway needs replacing. Phil goes into panic mode because screaming at vidya games is his "business" dood. Possibly caused by telling the condo board "hey I stream for a living, this is my business" and the condo board says "maybe you should pick another business because we're not looking for the next pewdiepie screaming at games here. Also replace your driveway it looks like ass"

I've always been a fan of your theories. I think this one might have won the grand prize.

PS: I'm just gonna leave this here.........

That is glorious subtle trolling at it's finest. Painting the portrait that most of Phil's patrons are children still getting an allowance.
It most likely went straight over DSP's head and he responded with a typical, "Huh huh."
That or it was too big of a paragraph for him to bother reading at all.

People who live in communities with HOAs are generally people who like the rules of the HOA - that's why they live there.

DSP has a 2 layer problem here.

-The first layer is that he can't go outside to do yard work because he will burst into flame in the sun/have a crippling gout attack.

-The 2nd layer is that he has a shitty attitude, which means the HOA is going to relish throwing the book at him.

This could be masterful trolling. If so I salute this brave lad.

DSP probably didn't even read them. He just wanted to live in a gated community so he could feel better than the plebs.
Exactly right. He wanted to feel like he was above other people so he choose the gated community also because he was growing increasingly paranoid as time went on. It's not like they have guards at the gates, anyone could scale that fence if they really wanted to but he really thought people were trying to home invade him.

They wouldn't have to scale it. I've seen pictures. You could literally just jump over it in places.

There is zero chance he read the HOA by-laws and declarations. We are talking about a guy too lazy to perform 25 seconds of simple research for some of the stupid issues he can't figure out on a daily basis.

I bet he threw out the by-laws when he moved in without paying them any mind.

I always find people that bitch about HOA's bring it upon themselves. The stuff you read on the internet are generally extremely one sided. Like idiots that one to put chicken coop in their front yard or a 40 ft flag pole.

The bylaws and everything are always present when you sign on the dotted line. If someone fails to read it, its their own damn fault.

So naturally I expect DSP to routinely have issues with his HOA.

I don't think it's possible to buy a condominium without an HOA because the individual homeowners don't own the outside of the building (as far as I can tell) or the land outside the condo.

"When you purchase a condominium, townhouse or another type of property in a planned development such as a leased land property or a gated community, you are obligated to join that community's homeowners' association (HOA) and pay monthly or annual HOA fees for the upkeep of common areas and the building. If you are considering purchasing one of these types of properties, you should be aware of the following nine things about homeowners' associations and how they work before you buy."

Other than weird covenants and restrictions, you also want to know how much the HOA can stick you with for random shit the HOA guys.

For instance, will you wake up one morning with a bill for $5,000 for your share of a swimming pool you don't even want which is somehow conveniently built next to the main HOA dude's place?

I agree that you generally only hear one side of the story, but for every chicken coop incident there's a small unobtrusive window mounted bird feeder that the HOA refuses to approve (when the the rules allow for such things if approved...I mean it's a small thing that no one will notice for Odin's sake! Do these people hate birds? Power drunk old lady...she has a damned concrete frog outside her door...it's hideous! Sheesh. It's probably a racial thing.).

But your point that HOA's are almost always painted as the villain in the story when homeowners are quite often equally unreasonable is well made.

The primary reason lives in condos is because he's too lazy to do any fucking work. Mowing, shoveling snow, he doesn't want to do any of it. Hell, he doesn't even want to take the time to install his own window blinds. Fair enough, but the blinds thing as well as the interior painting actually annoyed me tbh. Sorry, and no offense to anyone here, but my respect is a little diminished for a man who has no desire for self reliance to learn how to swing a hammer or use a fucking power drill. It's pathetic. He wants everything done for him cause he's too busy doing vidya. Give me a fucking break.

I honestly think that deep down, he realizes that almost everything he does produces terrible results. His ego is huge, yeah, and he's dumb enough to be oblivious to a lot of his own short comings. But his failures are so consistent and glaring, at some point he has to have internalized that he's just bad at everything he touches. His belief in his own superiority survives by constructing this narrative that he's too busy and important to do common tasks , so he has to pay the peasantry to do basic handiwork for him. Somewhere though, really really deep down, buried under mounds and mounds of DSP brand salt, I think Phil Burnell knows that if he tried installing his own blinds it'd end with three out of ten windows actually having them installed at all, two of those being installed on the bottom, the other one broken in half, and him with a screw through his palm.

We know he has his meeting on Monday, so I can guess what will happen on Tuesday...

*snort* so guys, looks like a few things are going to change in my life, but you know I'm the underdog and I've been the guy with the 'true and honest' opinion on things who tells it as it is and what i'm telling you right now is I really need your help. Please beg, borrow or steal your way to a plane ticket down to Renton for this month's new and exclusive patreon goal for the first episode of DSP Fixes It. The stupid people at the HOA have come down on me with a bunch of rules they never even came and personally told me existed! what morons! So it's going to need a few people to step up and support me to keep doing this job and providing FREE content online to everyone. I need a painter, a plumber, an HVAC specialist, I need someone who knows how to replace a driveway as well as someone who can deal with mold infestations. I know this is a bit more of an ask than last month's patreon, but you WILL get a double reward with this, you get to come to my house to personally meet me and help me build my dream house as well as get a special forum rank!
