Alex likes to lie, a lot. They've changed their version of events easily half a dozen times now. They've spun multiple different narratives to multiple different people, then tried to go back and delete/DMCA out all the evidence.

But now they've been deposed, and if they later go into court and try to change their story again, now it's been legally documented that they're committing perjury. Hell, I wouldn't be surprised if what they said in the deposition directly contradicted their 'response' to the suit in some way. Alex isn't smart enough to know how to keep their lies straight.

That's my guess as to why Alex is suddenly acting like they want to settle.

I think the deposition probably spooked Alex more than a bit. He suddenly discovered that it’s not schoolyard he said she said crying to Mommy. He was probably asked a lot of questions that he did not know the answers to. And a lot that he did likely did not work in his favor. Stuff like “did you cash a check number so xyz issued on date for xxx amount? Did you cash one numbered abc on date2 for same amount? Is this your signature?” Etc. And let’s be frank, this fool can’t even get his own name correct or consistent in a court of law, what hope does he have of keeping his meandering and insane stories straight.

Yeah I know. I wonder if Mauer has an inkling that this may finally get Google to shut him down? We saw something similar with one of those lunatic Eastern European Game devs going after Sid Alpha in some similar way. What Mauer fails to appreciate is Youtube is legally conscribed by the DMCA in how they handle DMCA and Trademark claims. YouTube must pass them through and cannot apply their own judgement. Hence it is very difficult for them to stop or shut down for those claims. But a “Privacy Complaint”? Over a public records document? That’s pure internal policy of Youtube. YouTube is allowed to make judgement calls and take direct action. There is no laws regarding Youtube Privacy. YouTube can just as easily look at the claimant, see the ongoing pattern of abusive behavior towards others, and the attempts to manipulate YouTube’s systems to harass others, and drop the ban hammer. Close his accounts, block his digital communications, and require him to submit any DMCA take down notices via snail mail.

He was kind of retarded putting the Birth Cert on YouTube in the first place, they're pretty protective of that stuff on that platform.

Honestly Sid alpha strikes me as kind of retarded in general.

To be fair to him, Alex did send the birth certificate to SidAlpha themselves as their 'press release'. And he redacted their parents' names (which Alex didn't bother doing) to protect their privacy. Sending someone a personal document saying to use it as a 'press release', and then throwing a public fit when that someone uses it, is disingenuous to me. Sid's not handling this in the smartest way, absolutely, but I don't think he's in the wrong on this specific point.

He really should stop responding to Alex's pokes though. It's just feeding into their delusions of persecution and victimhood. If he wants to do it to get more clicks, then he doesn't have a leg to stand on to complain when Alex spergs on him constantly.

So what now? Does French have any way to request/demand the final outcome of the judgement, or does the judge just decide what happens? If the judge decides, is the deposition available for his review, or not yet?
 
id think alex, len, and the judge meets off the record to discuss the terms and then they'd have a hearing to announce default judgement...but thats only if len and don want to accept it. seeing as how alex is the defendant in the case, the onus is on imagos to either accept it or do this:

The default has already been denied. A motion for summary judgment is more likely at this point. Or a motion for judgment on the pleadings, since there's no contested issue of material fact and the pleadings themselves show this.

After the launch of the game, Alex Mauer decided she wasn't being properly compensated for her work, so instead of hiring a lawyer, he has decided to rally people to his side by spamming DMCA notices at rando Youtubers who were streaming the game. Surprisingly, Pearl Harboring the Youtube channels of innocent nobodies didn't win him any allegiances, rather it had the effect of being perceived as an act of extortion. When confronted about the DMCA claims, he had this to say.

At first glance, one might be inclined to assume this dinky, nobody indie company have found themselves in a Ken Penders scenario, one which entails the non-existence of a work for hire contract, preventing the company from proving they have sole proprietary rights of the work created for Starr Mazer by the contractor. Evidently not.

Rather than taking Alex to court for falsely representing them, the indie developer bends knee to Alex and removes the game from Steam only to put it back up with the soundtrack completely removed.

Alex then claimed he also created the sound effects for the game, and once again, the indie company that owns sole custody of the intellectual property rights to this music as forsworn to them by her in a work for hire contract, folds. They removed the game from Steam yet again, presumably only to put it back up without sound effects later.

To top off the shit sundae with a red, red cherry, he has decided that the going price for an album of 23 tracks of 8-bit Mario Maker music is $1000.00 USD.

Not even the best of mainstream bands that sell out every venue they appear in before the internet piracy era could ever get away with selling each copy of their album for a $1000, not even if it were plated with gold and diamonds. Best yet is since this is Bandcamp of all places to upload your music, everyone can just listen to these songs for fucking free all day erry day.

The most insulting part is he couldn't even be arsed to give each song their own name, they're labeled by the level numbers and phases they were arranged in during game development.

If this weren't the modern internet age, I would have to leap to the conclusion that this over the top scandal was a hoax, a ridiculous viral marketing strategy to put the independent game developer company into the spotlight. But alas, the autism is too real to not be true.

I’m not sure you actually could lambast Alex any deeper into poverty?

I'm kind of surprised he hasn't sent Null an angry letter over his Lolcow Wiki article.

Now now he only has a few crayons left and Lemnard still hasn’t given him the markers that Alex defended!

They don’t have a choice. It’s Federal Law that they have to. If YouTube exercises their own judgement regarding the legitimacy of claims they lose their safe harbor status. The problem is the law never anticipated DMCA claims being used as weaponized autism for personal or political purpose. So YouTube is greatly restricted in applying even basic common sense to things.

But this latest claim wasn’t DMCA. It was a YouTube TOS claim regarding privacy. YouTube has full freedom to apply common sense and hammer the obvious stupidity hard with that one.

Pretty much this. Though I doubt Lemnard will go with a motion for judgment on the pleadings. Having been burned by the default, he will most likely request summary judgement instead. The difference is minor, but in the case of summary judgement the exceptional defense of a pro se defendant no longer becomes relevant as the matter at hand is a bare bones issue of law. Did X hurt Y, and if so, how much compensation should X give to Y? There was a time for Mauer to settle this amicably, but that time has passed. Schiller may hold out doing anything in the hope the parties will reach settlement, but I seriously doubt French will settle at this point.

Outside bet is Schiller will let this go to trial. It really depends on how worried he is about an appeal by Mauer on the matter as well as the damages. Jury verdicts on the other hand are really hard to overturn in US law.
