The government is constrained by both the US Consitution and the constitution of whatever state is under discussion. Most laws regarding commerce are judged using the rational basis test, which is a far easier test to meet than the compelling interest test, which is used to evaluate laws that more directly encroach on protected areas. There's no right to hire a hooker in the Constitution, and the government can point to all sorts of ills that could arise from legal prostitution (sex trafficking being chief among them). He could make the argument that the government has no vested interest in banning prostitution, but it would be very easy to refute, even if you exclude morality arguments. I don't think any normal person is going to be in favor of a law that increases the chance of women being forced into sex work against their will. Fixing that issue is a whole different argument.

I could be completely wrong about the legal arguments, it's been a long time since my Constitutional law classes. Law school was not my thing.

He's actually arguing based on rational basis, as Obergefell was actually adjudicated based on that. It is a sort of hybrid rational basis test, sometimes called "rational basis with bite," and originated (or was at least first articulated in its current form) in City of Cleburne v. Cleburne Living Center, Inc.

Spoiler: legal sperging

In this case, the city had tried to kick out a living center or group home for retarded people using a zoning rule. In this case, the zoning rule wasn't neutral but specifically prohibited facilities for the "feeble minded" and was therefore directly aimed at the population in question. Disability isn't one of the suspect categorizations that automatically trigger strict scrutiny, like race or religion or national origin, so the Court used (or at least claimed it used) rational basis.

At least on paper, "rational basis" requires an actual "rational basis," although in practice, that is generally almost anything coherent enough to be expressed in language. All sorts of incredibly dumb laws pass this kind of review, as courts are not intended to be some sort of veto on legislation by wise men. Laws are, generally, presumptively constitutional.

However, in that case, the Court found that a "bare [. . .] desire to harm a politically unpopular group cannot constitute a legitimate government interest." While strict scrutiny requires a "compelling government interest," even rational basis still requires a "legitimate government interest," and that sort of interest still requires it to be within the enumerated powers of government and, specifically in these cases, not to violate those rights protected under the Bill of Rights and subsequent Amendments, in this case the 14th.

In any event, the fact that Russ actually grasps this distinction is why I mistook him for possibly being a competent legal thinker when I first saw this argument. It's intelligible, it applies the correct standard, and actually does make at least a coherent argument for why it follows from established law. It's just very unlikely to succeed, since as I have pointed out, Obergefell is an incredibly narrow decision on its grounds, and as a 5-4 by Kennedy, he is unlikely to expand it in a way that would strongly hint at essentially establishing strict scrutiny for nearly all statutes that discriminate between populations whether or not they're "suspect classes," like race, religion and national origin.

I could literally sperg for 50 pages or more on this subject alone (and actually have in the past), so I'll cut this short.

His actual argument is not unintelligible or even without merit, or at least it isn't patently frivolous. It's just not one the courts are going to endorse. If they did, it would be overruled at the Supreme Court level, probably unanimously, because granting it would essentially upend constitutional review as we know it. It would render all legal distinctions between populations at least quasi-suspect.

Whether he likes it or not, his only real forum for a policy complaint like this is with his state legislature, which considering it is Utah, is never, ever going to legalize prostitution so long as it is even remotely similarly constituted as it is now.
