Ok, this to me make no real sense, the case has been ongoing for years with her local police, they have taken DNA samples (how they would've taken those is beyond me as it would have been at least a few days I imagine before she went to the police. Also in most countries if the police has such a great case, they will not wait for the victim to start to make the case overseas, but instead would themselves through the relevant domestic procedures do so. They would not let a case lie there for years without doing anything. I'm not saying it isn't true, but this part makes no sense to me and would in most cases really be a terrible botchjob from the police/prosecutor. You are basically accusing Phil of rape, now I don't like the guy, but I hope there is at least something to back this up, because this is quite a severe allegation. Now depending on which state this occurred in, it might also be that anything less than rape would not be outside the statute of limitations.
Also as you say there is more then enough evidence, including DNA samples, I'm sorry but those by themselves are not convincing evidence to do anything. The only thing that could mean something truly indicating sexual assault, is if there was semen due to the secual assault. Unless there are clear signs of forceful intercourse, which in the case of daterape, most cases is not the case, the DNA would proof nothing other than that there has been intercourse. Only if this is maybe combined with a toxicological screening of the victim clearly showing that she has been drugged, which is unlikely as this would have taken place in the US, while she went to her local law enforcement, which I believe would mean that she would not have gone to the police within 24 hours. Thus if DNA evidence is the main evidence I don't think that this is a strong case in anyway
Another thing, a few days ago you still said you would not say anyhting because 'it wasn't your place to tell'. how come it now suddenly is?
