This isn't true at all. Defamation per se, which Washington has, would automatically assume damages. The form of those damages and what kind of statements qualify would vary depending on where Phil actually files. The accusations of sexual assault would OBVIOUSLY qualify and accusing him of hiring would most definitely qualify especially given the vigor with which this was accused here.

There was no provable financial harm- there would be for example if he lost traditional employment over the allegations- and I don't think he'd be able to successfully argue his reputation changed one way or the other based on what's happened so far.

Probably cause it was a waste of time.
