What happened?
How long is the ban for? How many bans left does he have?
What has Phil said directly? (no speculation version, these are all direct things DSP has said)

Here is his first YouTube stream regarding the ban:

What happened?
- Phil was recently suspended on Twitch on February 26, 2018 (link to kf thread); that was his first suspension and this thread covers his second suspension.
- On the 27th March, 2018 a user named "galahadofgondor" entered DSP's Twitch channel and made a single comment regarding Phil's habit of quitting games before completing them. There is no other record of the same user leaving any other message on DSP's channel
-
- This comment was left during Phil's second stream, specifically during a break which means the video footage of the entire incident was never uploaded to his YouTube channel. The footage included of the incident was obtained from a Twitter user who claimed to have reported DSP for the incident.
- Phil usually does not react to general comments and only usually reacts to cheers or tips made by users. Tips are not recorded via chat log and so far no one is able to tell whether this user left a tip which contained a message stating something else (although tips are not tied to Twitch accounts so this scenario seems unlikely)
- Phil read the comment and banned the user and made remarks regarding their physical appearance:
- "by the way, the hilarious part was that the idiot actually had his picture as his avatar here on Twitch, he's an overweight, disgusting looking guy with a blue dyed beard, he's a complete fucking idiot [laughs] if you're gonna be an idiot in someone's stream chat, at least don't show what you look like in real life, especially if you look like a complete moron. Like hide that from the internet so we can't also make fun of you afterward [laughs] alright.."
- This video does not include how Phil actually reacted to the comment, and only includes his reaction to the user's appearance. So far no one has produced video of his comments prior to this incident (or the video afterwards)
- This is a picture of the user in question:
-
- On the 29th March, 2018 during his stream of Far Cry 5, Phil's channel was put into suspension with no prior notice to Phil (according to what he has said).
- Phil made several tweets regarding the suspension (which he has subsequently deleted) claiming that it was for harassment and further claiming that he had no harassed anyone:
- Phil subsequently made a "spontaneous" YouTube stream in which he appeared to be visibly nervous regarding the ban (indicated by his chair shaking) he also was unable to fully utilize the YouTube features because he wasn't familiar with them
- Phil then ended the stream claiming he was going into a phone call with Twitch regarding the suspension.
- Phil then made a tweet saying he was still working on resolving things and was going to have dinner and said he was having another discussion with Twitch shortly after. This tweet has also been deleted.
- Phil did another stream on YouTube in which he explained the details of his ban more clearly (link to video on DSP's YouTube channel)
- Prior to starting the video in a section that was cut out of the upload made later, Phil explained the video was going to purely based upon the facts and not his opinion.
- Some have speculated that this may be related to his previous ban in which he claimed to have an "inside contact" at Twitch which resulted in a member of Twitch staff receiving a small "tweetstorm" from people seeking clarification on the comments DSP had made.
- DSP has also been caught out by a journalist previously for fabricating quotes made by that journalist regarding his "detractors" (link to video of DSP attempting to fabricate quotes from Patrick Klepek, a former GiantBomb journalist, having claimed that said journalist had called his critics "mentally ill" among other things.)
- In the hour long video he admits responsibility for the ban however also claims the user who he insulted had deliberately tried to bait him into the situation.
- He claimed that he was told by Twitch a number of things including that as a Twitch partner he was not bound by the "3 strikes rule" as well as claiming that Twitch had told him that any subsequent suspensions in the next 90 days would result in increased suspension lengths.
- Prior to starting the video in a section that was cut out of the upload made later, Phil explained the video was going to purely based upon the facts and not his opinion.
- Besides the given reason for Phil's suspension there were a number of incidents in the past 30 days which may have also attributed to the suspension:
- Physical threats/insults aimed at an 11 year old girl
- These were made prior to the new Twitch ToS being active so possibly wasn't a consideration
- Being critical of Ninja (another Twitch streamer) for playing fortnite and hosting Drake
- Implying that if he were another person he might wish that Logan Paul's parachute would fail and he would drop to his death
- Physical threats/insults aimed at an 11 year old girl
- Phil has a signed exclusivity agreement with Twitch and although the exact contents of this contract are not public it has been speculated that based upon other Twitch contracts that he is bound to streaming on Twitch for gameplay videos.
- This means he is probably unlikely to able to stream actual gameplay via YouTube's streaming services or he would be in breach of contract
- Despite claiming the suspension is valid and that his comments regarding the user's physical appearance were misguided, Phil has also issued statements which try to claim he was provoked into this or that the user who was insulted did not have the best of intentions:
- Phil made several tweets regarding the suspension (which he has subsequently deleted) claiming that it was for harassment and further claiming that he had no harassed anyone:
72 hours. There appears to be no set amount of suspensions that Phil has "left" or if this number resets at any time. He is a Twitch partner with a signed contract so there seems to be a different rule set for him than regular users.
Why does this matter?
DSP claims to have a significant payment due in mid April for his state government backtaxes. Without the ability to use Twitch at this time he will maybe be unable to proceed with his planned "birthday stream" which he had planned to take place over a week. Should he be unable to do this planned stream its possible he will have to sell his second house which will possibly have a cascading effect on his other debts and financial liabilities.
