You have not alleged either of these things

For those following along at home, the four elements of a plain and ordinary negligence claim are (this is about as well-settled as the common law gets):

1. Duty to act or not to act with respect to the plaintiff
2. Breach of that duty
3. Proximate cause
4. Harm/Damages

The elements of a negligent misrepresentation claim are (this tort is not as well-settled as plain ol' negligence, so different states have slightly different takes--I haven't looked up Utah or Tennessee law to get the particulars of those states):

1. A false statement of an existing fact (promises don't count)
2. The speaker had no reasonable basis for making the statement
3. The speaker intended the recipient to rely on the false statement
4. The recipient reasonably relied on the false statement
5. As a result of that reliance, the recipient was damaged

That was the judge who bitch slapped him with fees for filing in bad faith and wasting everyone's time.

If he could only present his evidence, then he'd win, procedure be damned! He should really try working on getting to that point where evidence is presented first, but rules don't apply to him. He should probably start by suing for something tangible first (he'd fuck that up too though).
