We definitely did dodge a bullet and the SCOTUS is one of the reasons I don't think we'll ever have to resort to armed revolt to get D.C. to step the fuck off of our rights, but the irreconcilable difference between our points of view is simply that Americans and Europeans/Canadians have a different culture when it comes to the topic. We're definitely better. At the moment, and in general, whatever is on paper. Google results aren't just disappeared into the ether here based on the say-so of any Internet dipshit. People are not criminally prosecuted for /pol/-tier social media posts. Nobody has been threatened with jail time for making a funny dog video. ISPs need not fear defamation suits from wackos who think they should be held responsible for things their users say, while the EU just passed a law explicitly making them liable.

The DMCA sucks and is used to shut down a lot of content, but it similarly insulates ISPs from liability for copyright infringement by customers so long as they follow a simple and easy protocol. Frivolous lawsuits against ISPs of the Scientology sort were more or less stopped in their tracks by this.

By comparison, the EU has just passed legislation bringing all that shit back for Europeans.
