Law Justice Brett Kavanaugh Megathread - Megathread for Brett Kavanaugh, US Supreme Court Justice

they're good justices, brentt

https://www.cnbc.com/2018/07/05/trump-picks-brett-kavanaugh-for-supreme-court.html

President Donald Trump has picked Brett Kavanaugh, a federal appeals court judge with extensive legal credentials and a lengthy political record, to succeed Justice Anthony M. Kennedy on the Supreme Court, NBC News reported.

Kavanaugh, 53, is an ideological conservative who is expected to push the court to the right on a number of issues including business regulation and national security. The favorite of White House Counsel Donald McGahn, Kavanaugh is also considered a safer pick than some of the more partisan choices who were on the president’s shortlist.

A graduate of Yale Law School who serves on the U.S. Court of Appeals for the D.C. Circuit, Kavanaugh has the traditional trappings of a presidential nominee to the high court.

If confirmed, the appellate judge would become the second young, conservative jurist Trump has put on the top U.S. court during his first term. Kavanaugh's confirmation would give the president an even bigger role in shaping U.S. policy for decades to come. The potential to morph the federal judiciary led many conservatives to support Trump in 2016, and he has not disappointed so far with the confirmation of conservative Supreme Court Justice Neil Gorsuch and numerous federal judges.

At times, he has diverged from the Republican party’s ideological line on important cases that have come before him, including on the Affordable Care Act, the 2010 health care law which Kavanaugh has declined to strike down on a number of occasions in which it has come before him.

Anti-abortion groups quietly lobbied against Kavanaugh, pushing instead for another jurist on Trump’s shortlist, 7th U.S. Circuit Court of Appeals Judge Amy Coney Barrett, ABC News reported in the run-up to Trump’s announcement.

Kavanaugh received his current appointment in 2006 after five years in the George W. Bush administration, where he served in a number of roles including staff secretary to the president. He has been criticized for his attachment to Bush, as well as his involvement in a number of high-profile legal cases.

For instance, Kavanaugh led the investigation into the death of Bill Clinton’s Deputy White House Counsel Vince Foster, and assisted in Kenneth Starr’s 1998 report outlining the case for Clinton’s impeachment.

Democrats criticized Kavanaugh’s political roles during his 2006 confirmation hearing before the Senate Judiciary Committee.

“Your experience has been most notable, not so much for your blue chip credentials, but for the undeniably political nature of so many of your assignments,” Sen. Chuck Schumer, D-N.Y., said at the time.

“From the notorious Starr report, to the Florida recount, to the President’s secrecy and privilege claims, to post-9/11 legislative battles including the Victims Compensation Fund, to ideological judicial nomination fights, if there has been a partisan political fight that needed a very bright legal foot soldier in the last decade, Brett Kavanaugh was probably there,” Schumer said.

Kavanaugh's work on the Starr report has been scrutinized by Republicans who have said it could pose trouble for the president as he negotiates with special counsel Robert Mueller over the terms of a possible interview related to Mueller's Russia probe. The 1998 document found that Clinton's multiple refusals to testify to a grand jury in connection with Starr's investigation were grounds for impeachment.

In later years, Kavanaugh said that Clinton should not have had to face down an investigation during his presidency. He has said the indictment of a president would not serve the public interest.

Like Trump's first nominee to the Supreme Court, Neil Gorsuch, Kavanaugh clerked for Kennedy. If he is confirmed, it will mark the first time ever that a current or former Supreme Court justice has two former clerks become justices, according to an article by Adam Feldman, who writes a blog about the Supreme Court.

Kavanaugh teaches courses on the separation of powers, the Supreme Court, and national security at Harvard Law School and Yale Law School, and does charitable work at St. Maria’s Meals program at Catholic Charities in Washington, D.C., according to his official biography.

https://www.washingtonexaminer.com/...ett-kavanaugh-nomination-by-a-28-point-margin

After a blistering confirmation battle, Justice Brett Kavanaugh will take his seat for oral arguments on the U.S. Supreme Court with a skeptical public, a majority of which opposed his nomination. However, Democrats may not be able to exploit this fact in the upcoming elections as much as they hope, because the independent voters overwhelmingly disapprove of their own handling of the nomination by a 28-point margin, a new CNN/SSRS poll finds.

Overall, just 41 percent of those polled said they wanted to see Kavanaugh confirmed, compared to 51 percent who said they opposed his confirmation. In previous CNN polls dating back to Robert Bork in 1987, no nominee has been more deeply underwater.

What's interesting, however, is even though Democrats on the surface would seem to have public opinion on their side, just 36 percent approved of how they handled the nomination, compared to 56 percent who disapproved. (Republicans were at 55 percent disapproval and 35 percent approval). A further breakdown finds that 58 percent of independents disapproved of the way the Democrats handled the nomination — compared to 30 percent who approved. (Independents also disapproved of Republicans handling of the matter, but by a narrower 53 percent to 32 percent margin).

Many people have strong opinions on the way the Kavanaugh nomination will play out in November and who it will benefit. The conventional wisdom is that it will help Democrats in the House, where there are a number of vulnerable Republicans in suburban districts where losses among educated women could be devastating, and that it will help Republicans in the Senate, where the tossup races are in red states where Trump and Kavanaugh are more popular.

That said, it's clear that the nomination energized both sides, and that the tactics pursued by the parties turned off independent voters in a way that makes it much harder to predict how this will end up affecting election outcomes.

All that cuck can do is make it a 50/50 split, and guess who has the tiebreaker vote? Pence.

A small nitpick. As far as I understand it, Flake's vote were nessesary to get the vote to the senate, but once there (as soon as no-one else defect) it's not, since the Vice president gets to break a 50-50 tie.

Otherwise that timeline looks accurate.

Since Grassley talked Flake into giving his committee vote in exchange for an FBI investigation, Kav is already primed for a floor vote, if memory serves. That McConnell and Trump played along with the whinging wuss's demand makes me assume there's a fear of another potential defections (presumably Collins or Murkowski) or some other game her being played that I don't understand.

If 50+1 votes were on lock, McConnell would presumably forge ahead, especially given that the odds of Manchin and Heitkamp damaging their re-election chances with Quixotic defiance of the majority is low.

before he said that there wasnt one thing on the entire internet of the devils triangle being a drinking game not one. even if it is 50 years old lingo there is old ass lingo all over the internet. at least one person would have it somewhere on the internet

and the "renate 9" was them just simply wanting to honor a great friend right?

im not saying anything about dr ford. or that he did any rape. all I talked about was he is clearing bsing about what the devils triangle is and what the renate 9 is. all he had to do was say yea I was a 17 year old idiot who was immature. no need to lie about some stupid shit he put in his year book. it just shows he lied about a couple things he had no need to lie about. not once did I talk about dr ford in this whole thread. for some reason you chose to type 2 paragraphs when all I talked about was the devils triangle lie and the renate 9 thing. I never talked about anything else. If you think 9 dudes made a club about that girl that they werent even great friends with is anything besides a club to brag they fucked her....then I cant help you. Again its not even a thing thats fucking bad at all for 17 year old kids, was just something he should've admitted out of hifh school stupidity

As well as I found it funny that he says polygraph tests are BS and not be counted on when less than a year ago he said how great they were and in modern day are very reliable.

None of those have to do with why he is actually there or any of that shit. Just a few things that clearly dont add up.

pretty ignorant of you saying I am pm'ing everyone when it was just you to, to say that I didnt bring up ford once that way wouldnt derail the thread

Ah the naïveté of the Millenials and the post internet generation.

Since we are talking about sex crimes, let me give you a stunning example of the internet’s ignorance. Back in the day from the early 70’s to 1989 there was a very well known Peditrician on Long Island, NY. He had the largest Pediatric Practice in the nation. He was the School Physician for virtually every Long Island School District. Laying hands on every school sports team in Nassau and Suffolk County. He was active in the Boy Scouts and dealt with hundreds of kids from their annually. He had a nationally known Counciling Program for Troubled boys. So well known in fact that the Catholic Church sent him dozens of victims of Pedophile Priests to councel. As you can probably guess by now, he was indeed a Pedophile. Not just any Pedophile. He was likely the most prolific Pedophile documented in US History. When they finally bagged him the Nassau and Suffolk DA’s Were absolutely confident of 1500 positively Id’d victims that they were able to speak with. (Most outside the SOL) They had another 3000 that they viewed as likely. Of which several dozen had taken their own lives. They convicted him for 14 and sent him away for 25 to Life. His name is Dr. Gary Cohen. This was a huge scandal in 1987. Right in the heart of the nations media center. It intertwined a number of other scandals as well. Such as the Catholic Church Priest scandal and Cardinal Law and his toady Bishop Murphy. It was a huge story in the LI area. To put this in perspective the Pennsylvania Grand Jury report shockingly revealed 100 priests molesting 1500 kids. This was one man molesting 5000. (If you wonder how, let’s put it this way. There were a lot of young men to whom it came as a surprise to discover Prostate Exams don’t normally start until age 50. He could easily fondle 10-20 a day, every day, during office hours. Except Saturday. Ol’ Doctor Gary was a firm practitioner of Honoring the Sabath.)

I’m sure you see a lot in that story that jumps out at you as something that there would be a good record of? Yet if you do a modern internet search, the only reference to it you might find is a recent Newsday article about a parole hearing in 2014. The case itself has no record on the searchable internet. This is common. Virtually nothing “local” or “regional” from the 1980’s was ever documented via the internet. Vast tracks of the decade were simply ignored. They were too recent to ever be part of historical archiving. Most news was often tv or radio coverage, which unless someone happened to save and convert a VHS tape, was largely lost to history. The internet is an incredibly lousy resource for anything 70’s and 80’s related unless it was some National event.

Another good example of this lack of 1980’s information is the Haunted Castle Fire at Six Flags Great Adventure on May 11, 1984. It was a huge story. With National coverage. Yet there is astonishingly little actual information on the internet about it. What little there is comes from one guy. An amateur filmmaker who happened to make a student project about in in 2004 and later wrote a book. Everything else is mostly scrubbed.

Don’t look to or trust the Internet for info on the 80’s. What little is out there is second hand posted years later by 90’s kids.

I'm from the same area as Kavanaugh (much younger though) and I've never heard of that slang expression.

I already said the last 5 messages that can be debated. But its fine if you haven't but all over the states its pretty popular and it can be backed up online. again for the 5th time that can be debated

What cant be is his clear lie of the "renate 9 club". he claimed to have only even hung out with her 2-3 times total. so him "honoring her as a great friend" in her year book is some BS. they all hooked up with her and made a club about it. again I say its not even a big deal, 17 year olds say shit like that. its just something that there is no need to lie about it for. Its something thats not even a big deal to lie about

That is just a clear lie and only other thing which is factual is less than a year ago he said modern polygraph tests are amazing and work great and should be used in court. But now when asked to take one he said they cant be relied on

I hope so, perhaps it is because of where I work, but there are just a shitload of crazy liberal harpies that would happily sacrifice the entire justice system and kill their own children just to stop trump from eating a pizza.

Alice More: Arrest him!
More: Why, what has he done?
Margaret More: He's bad!
More: There is no law against that.
Will Roper: There is! God's law!
More: Then God can arrest him.
Alice: While you talk, he's gone!
More: And go he should, if he was the Devil himself, until he broke the law!
Roper: So now you'd give the Devil benefit of law!
More: Yes. What would you do? Cut a great road through the law to get after the Devil?
Roper: I'd cut down every law in England to do that!
More: Oh? And when the last law was down, and the Devil turned 'round on you, where would you hide, Roper, the laws all being flat? This country's planted thick with laws from coast to coast– man's laws, not God's– and if you cut them down—and you're just the man to do it—do you really think you could stand upright in the winds that would blow then? Yes, I'd give the Devil benefit of law for my own safety's sake.

A Man for All Seasons, pretty apt to what you mention here. It's essentially the Dems right now in regards to stopping this "fascist conservative menace".

It's incredible how many, without batting an eye, say, "Yes, the law is important, but, only if it benefits those I like"

Or, chillingly - "Bad people don't deserve fair trials"

I used to see this attiude only really seep in from a few lone loony fundamentalists, but now, anyone to the right of Stalin who has been accused of more than a traffic ticket is automatically guilty by their idpol stack location relevant to accuser, and guilty to the point where even letting them mount a defense is a crime itself....

I'm rather indifferent to/haven't kept up much with the Kavanaugh affair so far but why is a gun control activist's statement given weight in this? What do school shootings have to do with sexual assault?

Intersectional victimhood. Anyone who's a victim is immediately on the right side of history and entitled to push the entire liberal agenda because they're both being harmed by the same people: enemies of liberalism.

Therefore you get gun control advocates shouting "Rape culture" to oppose border regulation....

You've been parroting this for several pages now, do you have an actual source for this?

nah you ask 100 people 99 will say its a 3 some or doing a chick with all 3 of her holes filled. even as a young middle school kid I knew that. and even everywhere online wikipedia, urban dic etc thats exactly what it is. not until he said that did you start to see the drinking game shit appear. id challenge anyone to find it being a drinking game that was actually uploaded with that definition before this past week. when someone tried changing the wikipedia on what it was that was minutes after he said that. same on urban dic only times saw that entered there was after he said all that. I guess it can be debated but I dont buy it, cant find that shit anywhere and im surprised more people haven't heard of it before

Not it doesn't you sperg. I'm old enough that "devil's triangle" immediately brought to mind the BERMUDA triangle which was a whole meme in the 80s.

OH LOOK! It's the first wikipedia result.
https://en.m.wikipedia.org/wiki/Bermuda_Triangle

And i see the cnn article, but I DON'T see it in the wikipedia edit history.
https://en.m.wikipedia.org/wiki/Special:History/Threesome

What i DO see is "devil's triangle" being added yesterday. No reference to Brett at all. Hm. That almost looks like the opposite claim. That the slang was added last minute yesterday...

"renate 9 club"

You know, there have been people fighting and fighting over decades for women to be able to spend time with men as friends, without scandal, without being regarded as use-and-discard camp followers. It's a staple of television shows, comics, and any other medium you can think of for any group of male characters to have a "token female" who is valued for her skills and general presence, not for her pussy.

And yet, the selfsame people who cry "MISOGYNY" over assumptions of that girl being the group bicycle, are now gleefully doing the same to a girl who managed it.

And you're perpetuating that, you bigot.

I was all the way back at page 13 last time i was here and noticed there are now 115 pages, the hell happened?

We got to watch the media go full retard in real time.

Yes. Yes. Keep pushing that racism straight out into the mainstream. Piss off even more moderately-minded people. Keep going.

Whoa there, older timer! I think the Alzheimer's must be setting in due to your advanced aged, because Cohen was indicted in December of '89, and didn't even get to trial until '91. Convicted on 27 counts of sexual abuse, 25 to 50 years sentence. You can find a pretty substantial paper trial from his initial appeal of his sentence in '94, to another appeal in 2001, all the way to his parole hearings in 2014 with a mild amount of Boolean filter know-how.

You're right that you probably couldn't find a copy of the case itself without contacting the Suffolk County Clerk's Office though because it's not a case that holds precedent value to be documented in a regional court reporter. But you can still find out about it if you look hard enough.

I know this is really :offtopic: but I just find it funny that the thing you're talking about actually happened almost entirely in the 90s.

Same. People I know are even saying "Incriminating evidence does not matter. A monster like that would cause untold harm and there should be no doubt that he's capable of such an atrocity." This has gone beyond simple TDS or funny shit like that, this is just... I have no words... Its like the Salem Witch Trials all over again but on a national scale fueled solely by pride and personal gain rather than fear or concern for the village. I mean it is funny to see them completely lose it, but then I realize just how fucked up this seems to be and how many lives they're trying to ruin.

Remember the days when the left would make fun of and decry McCarthyism? (Who, by the way, inestigated russian interference in USA elections and no that will never stop being funny to me.)

Now he has something in common with Jordan B Peterson.

Fascinating Captain. Apparently some Maryland Dems requested that the State Police investigate the “crime”. Here’s the response.

September 28, 2018
Ariana B. Kelly
Democratic Caucus Chair
Montgomery County House Delegation
Lowe House Office Building
6 Bladen Street
Annapolis, Maryland 21401

Dear Delegate Kelly:

This letter is in response to your September 25, 2018 request that the Montgomery County Police Department and State's Attorney's Office open a criminal investigation involving sexual assault allegations against Judge Brett Kavanaugh. First, let us be clear that our agencies take seriously all criminal reports of sexual assault or rape against any victim. The decision to report the crime of sexual assault or rape to law enforcement is a deeply personal one and a decision that must be made by the survivor. Our agencies understand and appreciate the impact that sexual assault has on survivors and investigates all reports to law enforcement to the fullest extent.

Law enforcement agencies and victim advocacy groups from around the nation promote a victim-centered policy toward sexual assault investigations. Efforts to note revictimize the sexual assault survivor are essential. We agree with the Maryland Coalition Against Sexual Assault and their Executive Director, Lisae Jordan, that the willingness of a survivor to come forward to law enforcement is an important factor in any criminal investigation. We remain prepared to investigate any allegations, should a victim come forward.

To date, there have been no criminal reports filed with the Montgomery County Department of Police that would lead to the initiation of any criminal investigation related to Judge Kavanaugh. Furthermore, the law at the time the offense occured is the law that must be applied to any charges that might be brought. For example, in 1982, assault and attempted rape were both misdemeanors and subject to a one-year statue of limitations. The Montgomery County Police Department and the Montgomery County State's Attorney's Office stand ready to investigate any sexual assault allegations from any victim where the incident occurred in our jurisdiction.

J. Thomas Manger
Chief of Police
Montgomery County Department of Police

John J. McCarthy
State's Attorney
Montgomery County, Maryland

So all of this is over a 36 year old Misdemeanor... with a 1 year Statute of Limitations. Take note of that! And compare it to the crimes of Beto O’Rourke, the Dem challenging Ted Cruz. Which the Dems and media are hand waving away.

You know, there have been people fighting and fighting over decades for women to be able to spend time with men as friends, without scandal, without being regarded as use-and-discard camp followers.

The #metoo movement has been undermining this from the start, and its only leading to more intense gender based segregation.

Sir, can we begin the Robot uprising now? Please? I'm ready to kill all humans...

Count me in. Lets kill some smoothskins!

OK, let's give her the benefit of the doubt, that she wasn't their prize fucktoy that they passed around like a pack of Jews with a gold dredel.

Let me explain something to you about the 70's and 80's that apparently you just don't get. Now, I'll put it behind the spoiler for everyone else with a working brain who was around at the time...

All right, first, you need to understand that the 60's and 70's had came and gone. Women had come home from Vietnam in body bags, Roe VS Wade had passed, women were being allowed in more and places. Men only clubs were being forced open to women on the basis of discrimination is wrong. Feminism meant "Different but Equal in the eyes of the law and society" not "I'm better than you!" like nowadays.

See, girls in the 80's, they weren't cry babies. They weren't victims. These were girls that carried rolls of dimes in their pockets or even a razor. Girls started playing on the softball teams, on the flag football teams, and no longer were they relegated to "Women Stuff" and that's it.

Tomboys flourished. Girls that liked working on cars suddenly got to take auto shop instead of Home Ec.

We were told to respect these girls (later women) growing up the 70's. TV and moves had female heroes (Hi, Ripley!) who said "We can be badass AND sexy AND talented" and strides were made in society. We were told to take the "Respect Women" we were taught, and apply it a little further, into "Treat them like they ask to be treated, how they CHOOSE to ask you treat them. Don't look down on them for their choices..."

The Sexual Liberation thing had reached maximum saturation, and sex-ed was being taught in schools. Contrary to Brianna Ghoul Wu, Alabamer did teach you that fuckin' made kids and ya might wanna wear a condom there champ.

Like I said earlier, if you were fucking a girl that wasn't a girlfriend and you were single, you didn't say shit. She'd just come over and say "Let's bang" and then she left. You didn't blather about it. It was this nice thing that the two of you did since sex negativity was on the downslope.

But what you fail to understand, on a horribly sexist look into your thinky-goo, is that a lot of women WERE just friends with guys. A group of 4-5 stones would have the heavy metal chick that hung with them that never fucked anyone. The tomboy chick that hung out with the gear heads or jocks. That hot shit preppie girl that had 3 foot high hair shellac'd with Aqua-Net that never fucked.

You know why they didn't fuck?

They didn't have to.

They had self worth beyond their goddamn cunts. They had hobbies, friends, went places, did shit, and none of it revolved around having a cunt.

They got to be people first, a cunt having titty bouncer second.

But the 90's kids seemed to have taken that, added the internet, and stirred in intersectionality so now they can never be beyond the color of their skin, their cunts, and their tits.

Nicely fucking done, you autistic faggots.

You took every fucking step your mother and father made for equality and shit all over it in the name of gibmedat and victim points.
