It’s just some nonsense about how all of Ya Boi’s communications & those of his followers will be brought into court & how that will impact this case & will justify Waid’s actions....

Well yes. But they miss that all their communication will be similarly brought out. None of D&C’s comm7nications constitutes Federal Crimes. But an alarming amount of the Industry Pro’s does. And you know what happens when discovery hits and you find Joe Quesada or Sana Ammanat or similar in that Facebook group discussing Mr. Meyer and his books publication? The Mouse gets added to the Mess. And Darth Mickey would not be pleased.

See at best all you could find in D&C’s communications is private people, unrelated to the industry except as consumers, being assholes. Not a crime. Not even really defamatory as it is private conversations with no direct impact on employment etc.

But boy won’t Waid’s communications lead to a treasure trove? There are clearly industry conversations r grading blacklisting Meyer and keeping him out. Blocking him from jobs, marketing, publication, jobs, etc. but once you open it you find who else they did this to. EVS? Jon Malin? Etc. it also violates a number of Federal Criminal statutes. Ones that the big corps take seriously. Sherman Act stuff is rare and fascinating as it can breach Corporate Shields. It can hold not just the corporation civility and criminally liable. It can hold the individual officers so personally. Companies traditionally had very rigid policies to avoid this. But Social Media has opened up new vectors of collusion. And a lot more legal exposure.

This is a point I made in the Meyer v Waid thread about why the case at-the-moment is limited to simply Waid. If it gets to discovery is when it gets really interesting. If Waid settles before then, it’ll kill all the fun tho. But I’m really salivating at what Gold might be in them thar DM/Text/PrivateFB/email records.
 
Settling before discovery is probably why Musk agreed to leave his company instead of fight the SEC.... he knew that even though this was the chance he lived for, getting his day in court to take down the trolls and haters, his lawyers told him that discovery would result in him being in court for the rest of his life for everyone he'd done it to and the web of misbehavior he'd quietly built online over the years.... and he had to fold or he'd leave with NOTHING and a jail cell waiting.

I think the same happens here, mostly because of those alluded-to mouse overlords telling the parties to offer a settlement with NDA and get the hell OUT of litigation, NOW.
 
The thing I’m really really curious about is if Ya Boi Zack is willing to forego a definite settlement in the hopes of getting that discovery phase & potentially blowing up the whole industry & exposing everything. Does he just cash in or does he go for digging into that goldmine & hoping that he finds something even bigger?

His best course of action depends on if The Mouse is backing Waid financially/legally. If they are he should settle because I'm almost sure it's impossible to win against Disney. If they aren't he should go for discovery and humiliate Waid where everyone can see it.
 
I honestly hope Waid loses, though I know there is a chance that Meyer will lose. The man is a complete psychological train wreck and I would not be surprised if he thinks of himself as Superman judging by the comments he made on that livestream he did with EVS last year. Given his own adolescent outlook on the world, he believes that he is always justified in his actions and immune from the consequences. Yeah, the early Siegel/Shuster Superman was a social crusader, but such a character could easily become a tyrant, which is why the scenario where the Man of Steel snaps and becomes a dictator has become popular, i.e. the Injustice series. Waid and his cohorts have a God Complex that they apply to their little fiefdom like the Regime from Injustice.

The thing is that their power does not extend past their little circle and the courts don't give a fuck about their activism. Too bad I suspect that losing this suit will not snap them out of their delusion.

That they also got him banned from Kickstarter doesn't hurt his case that he's been blacklisted. Christ these jackasses are fucking stupid.

And you know the very first thing in discovery, if this isn't somehow dismissed or settled before then, will include a request to produce all communications, private or otherwise, with other industry participants, including people at Marvel. If they have somehow been blissfully oblivious to any potential liability on their part, this will be a wake-up call. If Disney has somehow just been ignoring this as a spat between some peon comic book nerds, this will also awake the sleeping giant.

Mark Waid will be deposed and will be forced to put his factual claims on the record and answer deep, probing questions about his conduct. Lying will be perjury, and once he's on the record, he can't later change his story without having his deposition thrown in his face.

It's very likely to take most of a day, or perhaps even multiple days depending how hardball plaintiff's counsel wants to play, and give Mark Waid some quality time to contemplate the true level of his liability.

What we probably see first is an attempt to dismiss this on procedural or substantive grounds. The most I see possibly getting dismissed is the defamation claims, but I don't see that either. The tortious interference claim is clearly a colorable prima facie claim that can survive a motion to dismiss. If the facts are as Meyer says they are, the claim is valid. It is unlikely to be dismissed on 12(b)(6) for failure to state a claim.

Just like everything else these anti-CG idiots do, this only works if you already believe that Meyer is a bigot. If you don't believe that, this is just going to convince you that a there is a shadowy cabal of comic insiders with a large sphere of influence who go around trying to shut down independent creators.

If Mark Zaid is competent, he will tell Mark Waid not only to STFU immediately, but tell his idiot minions to quit making things even worse by publicly posting even more evidence proving elements of the claim against him. Whatever fucking idiot leaked that Kickstarter insider information just fucked Waid good.

Given the attorney Waid got (despite the ridiculous name), I can't imagine he isn't being backed. This is a guy that sues countries, you're telling some comic book guy, no matter how much tenure he has, could afford that?

I can see him getting backed due to the cancer that is the industry, but Waid is also really really stupid and also hideously delusional with his Manichean worldview. I can see himself financially ruining himself for a namebrand person tbh. The crackhead who was given ED before it was ripped from his addict hands did something similarly stupid when he was sued by that random guy and threw his money down a hole for namebrand too, and Waid comes off as about as smart as said crackhead.

As for my prediction: Waid is going to reee, stamp, and act like the socially retarded child he is as the case continues until a handler upfront tells him to can it because he's going to fuck over the incest orgy and if he continues he's going to be purged just like Trotsky and Bukharin. He then begs for a settlement before going off to be the person his parents wish they aborted after some more radio silence. He then gets a job regardless because that's how absolutely stupid and desperate to go bankrupt the comics industry is.

Per EVS, Waid has a net worth somewhere north of $1m. Not Trump levels of opulence, but enough to afford a decent lawyer for a while.

They can’t help themselves because they’re idiots and want people to believe they have power. They’re desperate to prove to everyone they are in control and those who aren’t in-line with their thinking will be fucked over. So in the end, due to their hubris, they’re just giving tons of evidence to DnC and fucking over Waid.

Which is literally what Waid is being sued for. Waid himself dug his own grave but he has buddies who brought their own shovels to help.

Can Meyer really get $75,000 in damages from Waid after making over half a million on IndieGoGo, which will most likely come out to well over $75,000 in profit once expenses are accounted for? If anything, it almost seems like Meyer should be giving Waid $75,000 as thanks for Streisanding his campaigns to wild success.

By no means am I arguing that Waid isn't a jerk here, but the more I think of it, the more I feel like this case is a waste of time. Meyer doesn't need the money, and it appears that Waid is wealthy enough that $75,000 won't teach him that much of a lesson.

This. You know how in some cop shows the suspect ignores the lawyer and starts bragging about their crimes, believing they are untouchable? I think that's what Waid is going to be like.

I'm not basing that just on fiction though. Someone at Kotaku did the same thing during the Hogan sex tape trial. I forget exactly what he said but it was something like how he wouldn't publish a sex tape only if it involved a child under 4 years old and other outrageous statements, until eventually saying that he was only joking and it's no big deal.

I remember another lolcow around the same time who changed lawyers like most people change socks. I think it was Alex Mauer but don't quote me on that.

Zack can still sue quite easily, since Waid caused delays on Jawbreakers due to his tard tantrum (time is money), forced him to put that money into self-publishing and shipping that could have been used elsewhere (both in labor and in funds), killed off several venues that he could have had due to this intentional attempt to blacklist, and ruined the original contract he had with Antarctic (one of the key elements to the case). It doesn't matter if there was a Streisand Effect due to this and Ya Boi made more money afterwards, Waid can be strung up by the bollocks for tortuous interference because of these things I mentioned; he genuinely ruined a contract, cried and raged so hard that LCS would close ranks and not stock it for fear of no Marvel trash, and also caused damages since Zack had to find new sources to make this book.
