Law Justice Brett Kavanaugh Megathread - Megathread for Brett Kavanaugh, US Supreme Court Justice

they're good justices, brentt

https://www.cnbc.com/2018/07/05/trump-picks-brett-kavanaugh-for-supreme-court.html

President Donald Trump has picked Brett Kavanaugh, a federal appeals court judge with extensive legal credentials and a lengthy political record, to succeed Justice Anthony M. Kennedy on the Supreme Court, NBC News reported.

Kavanaugh, 53, is an ideological conservative who is expected to push the court to the right on a number of issues including business regulation and national security. The favorite of White House Counsel Donald McGahn, Kavanaugh is also considered a safer pick than some of the more partisan choices who were on the president’s shortlist.

A graduate of Yale Law School who serves on the U.S. Court of Appeals for the D.C. Circuit, Kavanaugh has the traditional trappings of a presidential nominee to the high court.

If confirmed, the appellate judge would become the second young, conservative jurist Trump has put on the top U.S. court during his first term. Kavanaugh's confirmation would give the president an even bigger role in shaping U.S. policy for decades to come. The potential to morph the federal judiciary led many conservatives to support Trump in 2016, and he has not disappointed so far with the confirmation of conservative Supreme Court Justice Neil Gorsuch and numerous federal judges.

At times, he has diverged from the Republican party’s ideological line on important cases that have come before him, including on the Affordable Care Act, the 2010 health care law which Kavanaugh has declined to strike down on a number of occasions in which it has come before him.

Anti-abortion groups quietly lobbied against Kavanaugh, pushing instead for another jurist on Trump’s shortlist, 7th U.S. Circuit Court of Appeals Judge Amy Coney Barrett, ABC News reported in the run-up to Trump’s announcement.

Kavanaugh received his current appointment in 2006 after five years in the George W. Bush administration, where he served in a number of roles including staff secretary to the president. He has been criticized for his attachment to Bush, as well as his involvement in a number of high-profile legal cases.

For instance, Kavanaugh led the investigation into the death of Bill Clinton’s Deputy White House Counsel Vince Foster, and assisted in Kenneth Starr’s 1998 report outlining the case for Clinton’s impeachment.

Democrats criticized Kavanaugh’s political roles during his 2006 confirmation hearing before the Senate Judiciary Committee.

“Your experience has been most notable, not so much for your blue chip credentials, but for the undeniably political nature of so many of your assignments,” Sen. Chuck Schumer, D-N.Y., said at the time.

“From the notorious Starr report, to the Florida recount, to the President’s secrecy and privilege claims, to post-9/11 legislative battles including the Victims Compensation Fund, to ideological judicial nomination fights, if there has been a partisan political fight that needed a very bright legal foot soldier in the last decade, Brett Kavanaugh was probably there,” Schumer said.

Kavanaugh's work on the Starr report has been scrutinized by Republicans who have said it could pose trouble for the president as he negotiates with special counsel Robert Mueller over the terms of a possible interview related to Mueller's Russia probe. The 1998 document found that Clinton's multiple refusals to testify to a grand jury in connection with Starr's investigation were grounds for impeachment.

In later years, Kavanaugh said that Clinton should not have had to face down an investigation during his presidency. He has said the indictment of a president would not serve the public interest.

Like Trump's first nominee to the Supreme Court, Neil Gorsuch, Kavanaugh clerked for Kennedy. If he is confirmed, it will mark the first time ever that a current or former Supreme Court justice has two former clerks become justices, according to an article by Adam Feldman, who writes a blog about the Supreme Court.

Kavanaugh teaches courses on the separation of powers, the Supreme Court, and national security at Harvard Law School and Yale Law School, and does charitable work at St. Maria’s Meals program at Catholic Charities in Washington, D.C., according to his official biography.

After a blistering confirmation battle, Justice Brett Kavanaugh will take his seat for oral arguments on the U.S. Supreme Court with a skeptical public, a majority of which opposed his nomination. However, Democrats may not be able to exploit this fact in the upcoming elections as much as they hope, because the independent voters overwhelmingly disapprove of their own handling of the nomination by a 28-point margin, a new CNN/SSRS poll finds.

Overall, just 41 percent of those polled said they wanted to see Kavanaugh confirmed, compared to 51 percent who said they opposed his confirmation. In previous CNN polls dating back to Robert Bork in 1987, no nominee has been more deeply underwater.

What's interesting, however, is even though Democrats on the surface would seem to have public opinion on their side, just 36 percent approved of how they handled the nomination, compared to 56 percent who disapproved. (Republicans were at 55 percent disapproval and 35 percent approval). A further breakdown finds that 58 percent of independents disapproved of the way the Democrats handled the nomination — compared to 30 percent who approved. (Independents also disapproved of Republicans handling of the matter, but by a narrower 53 percent to 32 percent margin).

Many people have strong opinions on the way the Kavanaugh nomination will play out in November and who it will benefit. The conventional wisdom is that it will help Democrats in the House, where there are a number of vulnerable Republicans in suburban districts where losses among educated women could be devastating, and that it will help Republicans in the Senate, where the tossup races are in red states where Trump and Kavanaugh are more popular.

That said, it's clear that the nomination energized both sides, and that the tactics pursued by the parties turned off independent voters in a way that makes it much harder to predict how this will end up affecting election outcomes.

Picking your battles can make quite a difference. They could have let Brett take office, maybe win some seats and then impeach him.

But no they had to blow their load way too fucking early and now their plan has completely backfired in the most spectacular of ways. That blue wave just turned into a red fucking tsunami.

Or, better-better, they could have taken the L on Gorsuch as a status quo appointment and kept the filibuster for when they actually needed it.

Cocaine Mitch has started to notice. So has Grassly. Weirdest is all is today showed the deepest darkest Never Trumper Rino Wing of the GOP relishing in wining using Trumpian tactics and style. The Deplorables have certainly noticed. That includes pretty much ALL of the White Men, and all of the Suburban Soccer Moms. 30% of the Black population has taken note. Maybe 40% of Black Males. s5-40% of Hispanic voters have seemingly noticed as well.

On the other side I think Schumer may be self medicating. It's possible Nancy Pelosi has had an actual stroke and thinks she is in the Reagan Years again. Everyone else is shuffling chairs getting ready for the big blame game. They aren't in full panic yet. The Media the (lying untrustworthy) media, is telling them that they have lost the Senate but may still win the house. Oh and the Governors are gone... poof... gone... try again in 2024. But they suddenly realize that this election looks more like 2016 and less like 2012.

Positive article for Kavanaugh:

Legal icon Alan Dershowitz says a kind of “sexual McCarthyism” displayed during the Supreme Court nomination process of Judge Brett M. Kavanaugh has set a “terrible precedent.”

The Harvard Law professor emeritus told “Fox & Friends” Friday that while Judge Kavanaugh would not be his pick for the high court if he were in President Trump’s shoes, he is dismayed with the kind of criticism directed at the judge.

Democrats claim that allegations of attempted rape by college professor Christine Blasey Ford should terminate the judge as a viable choice for the high court.

None of the individuals cited by Ms. Blasey Ford as witnesses to the alleged incident have corroborated her claims.

“The question is now all about whether we allow a nominee to be discredited without hard proof, hard evidence, and whether or not this established as a precedent for the future where nobody is going to want to serve on the bench,” Mr. Dershowitzsaid. “The idea that he can’t teach in Harvard now because he was suspected? When I was growing up in Brooklyn colleges as a student they fired professors because they were ‘suspected’ of maybe being communists when they were in their 20s. Suspicion was enough. This kind of sexual McCarthyism is a terrible, terrible precedent.”

Mr. Dershowitz said that allegations of sexual assault should be taken seriously, but citizens and lawmakers should also acknowledge that witnesses sometimes lie or make up stories “out of whole cloth.”

“We have to look into all of these issues,” he said.

Senators kept the process moving forward on Friday by overcoming a Democrat-led filibuster.

A full confirmation vote for Judge Kavanaugh is scheduled for Saturday.

This is the problem with this country. The "last" witch burning was in around 1950. The practice didn't die, it just changed form.

Or, better-better, they could have taken the L on Gorsuch as a status quo appointment and kept the filibuster for when they actually needed it.

Every time, every fucking time the dems get some sort of info that may or may not work against the GOP they go full re.tard without even considering the consequences. First the filibuster on Gorsuch, now this.

Isn't Sun Tzu's Art of war a required reading for these parties?

Twitter and leftist media has spent weeks demonizing white men and white women. Thinking, if they make one more generalization it will change things. Someone in the party needs to take a stand and call this shit out.

They learned literally nothing after Hillary lost.

Let it all burn to ash, and then the healing can begin.

I have to wunder...

is there a secret cabal inside the democrat ranks? A cabal set on destroying the current iteration of the party as is for some nefarious reason?

This is "deplorables" all over again. The Democrats just spent the week attacking a white male with every dirty, slimy trick they could scrape up, then expanded it to all white men then went ever further up the crazy path and are now blaming white women for the GoP actions?

Is anyone in control at DNC HQ or do the inmates run the asylum? Cause this is a surefire way to lose any last shreds of democratic hopes for the mid-terms.

They handed a unifying and empowering event right to the GoP while showcasing to the world how utterly insane the current mouthpieces of the party are.

Where are the DNC people? Where is Warren and Perez to run damage control? Why are they allowing Harris to run wild? Is anyone even in control at the DNC?

How can a supposed professional political party keep making such stupid, repeated mistakes like this? Does Hillary want the DNC burned to the ground for failing her? Do they want to never ever get the white middle class vote again this decade? (Which btw still makes up over 65% of the voting populace.)

Have the just given up on ever getting into power again? You just cant win an elections with minority token voters, SJW's, immigrants and the few remain upper class liberals. Its not mathematically possible.

So instead of saving their energy and allies for the upcoming mid-terms they are burning their world down around them for spite like 3 year olds. Showcasing the true nature of the type of people that are the "core movers and shakers" of the new Democratic Party.

Seriously...

is there something going on in the inner DNC? Some cabal that wants to see this last generation of boomer politicians go out in a blaze of uselessness? Some power struggle as hidden figures battle it out for supremacy?

As far fetched as it may sound...does the currently reality of this being a planned and fully supported democrat operation make any more sense?

God damn!

What a timeline!

Thank you Donald, this last years has been absolutely amazing! I thought you could never top the election salt but damn son!

Yes, Silverman, companies do tend to expect financial compensation when they provide a service. This is actually very common.
S...she doesn't know how ISPs work. She's so privileged she doesn't even set up her own internet or pay her own bills. This is incredible.

Its mind blowing honestly, if this Kavanaugh thing hadn't turned into a huge mess too the dems would probably be on track to take control of the senate and house, but they're such idiots they cannot help themselves
No. The Senate was always a pipe dream just because where the seats up for election are right now. Even hard left pollsters gave them a 1/3 chance at best to take the Senate, and that was at the height of the blue wave hysteria.

The leftist version of the tea party is in charge.
You are underestimating and discounting the Tea Party. The Tea Party was very successful at removing a number of RINOs and Democrats alike from the house and even the senate. The Tea Party was wildly successful at the State and Local levels as well totally crushing the Democrats there. There is a reason Obama couldn't get anything done legislatively after the Tea Party came about.

The Washington Times and Washington Examiner are considered center right, so that's not terribly surprising. Regarding the firing communists thing: it is kinda looking like that was a good idea now isn't it. Maybe we need to start firing communists who work in academia again.

I think it's more to do with hubris, these people think they're the smart ones, the moral ones. They look down so much on their opponents that they believe that they win against anyone.

If the Democrats got an amnesty for the 'dreamers' it would make it very hard for the Republicans to win

https://www.dailywire.com/news/26559/amnesty-dreamers-would-harm-everyone-and-kill-michael-j-knowles

Other possibilities would be to let in large numbers of fake refugees, Merkel style or allow non citizens to vote.

Any of these would make it very hard for the GOP to win again.

I.e. the Democrats are awful but don't count them out anytime soon.

Goes without saying. I think everyone's well aware the Democrats not only intend to, but their only way to win is to import a bunch of non-citizens, because Americans do not want them in charge anymore. So just destroy America.

While the lesson that they should learn is "regressing to autistic screeching doesn't work," the Democrats will instead no doubt decide their failure to bork Kavanaugh was because they weren't woke enough and get even more puritanical.

I'm predicting a Trump administration until 2024 based on this. They just don't have a platform other than to ree about intersectionality.

That is the face of a woman who has just been utterly and thoroughly trampled, and knows exactly what's coming next.

WHAT'S WRONG WITH YOUR FAAAAACE???

I have to wunder...

Current party leadership is a) completely broke and dependent on the Clinton machine for what remaining funds they have, and b) composed of geriatric Boomers who have been doing this "pander to our base with identity politics" Third Way Democrat shtick for 30 years and literally know no other way to appeal to their base.
