Law Justice Brett Kavanaugh Megathread - Megathread for Brett Kavanaugh, US Supreme Court Justice

they're good justices, brentt

https://www.cnbc.com/2018/07/05/trump-picks-brett-kavanaugh-for-supreme-court.html

President Donald Trump has picked Brett Kavanaugh, a federal appeals court judge with extensive legal credentials and a lengthy political record, to succeed Justice Anthony M. Kennedy on the Supreme Court, NBC News reported.

Kavanaugh, 53, is an ideological conservative who is expected to push the court to the right on a number of issues including business regulation and national security. The favorite of White House Counsel Donald McGahn, Kavanaugh is also considered a safer pick than some of the more partisan choices who were on the president’s shortlist.

A graduate of Yale Law School who serves on the U.S. Court of Appeals for the D.C. Circuit, Kavanaugh has the traditional trappings of a presidential nominee to the high court.

If confirmed, the appellate judge would become the second young, conservative jurist Trump has put on the top U.S. court during his first term. Kavanaugh's confirmation would give the president an even bigger role in shaping U.S. policy for decades to come. The potential to morph the federal judiciary led many conservatives to support Trump in 2016, and he has not disappointed so far with the confirmation of conservative Supreme Court Justice Neil Gorsuch and numerous federal judges.

At times, he has diverged from the Republican party’s ideological line on important cases that have come before him, including on the Affordable Care Act, the 2010 health care law which Kavanaugh has declined to strike down on a number of occasions in which it has come before him.

Anti-abortion groups quietly lobbied against Kavanaugh, pushing instead for another jurist on Trump’s shortlist, 7th U.S. Circuit Court of Appeals Judge Amy Coney Barrett, ABC News reported in the run-up to Trump’s announcement.

Kavanaugh received his current appointment in 2006 after five years in the George W. Bush administration, where he served in a number of roles including staff secretary to the president. He has been criticized for his attachment to Bush, as well as his involvement in a number of high-profile legal cases.

For instance, Kavanaugh led the investigation into the death of Bill Clinton’s Deputy White House Counsel Vince Foster, and assisted in Kenneth Starr’s 1998 report outlining the case for Clinton’s impeachment.

Democrats criticized Kavanaugh’s political roles during his 2006 confirmation hearing before the Senate Judiciary Committee.

“Your experience has been most notable, not so much for your blue chip credentials, but for the undeniably political nature of so many of your assignments,” Sen. Chuck Schumer, D-N.Y., said at the time.

“From the notorious Starr report, to the Florida recount, to the President’s secrecy and privilege claims, to post-9/11 legislative battles including the Victims Compensation Fund, to ideological judicial nomination fights, if there has been a partisan political fight that needed a very bright legal foot soldier in the last decade, Brett Kavanaugh was probably there,” Schumer said.

Kavanaugh's work on the Starr report has been scrutinized by Republicans who have said it could pose trouble for the president as he negotiates with special counsel Robert Mueller over the terms of a possible interview related to Mueller's Russia probe. The 1998 document found that Clinton's multiple refusals to testify to a grand jury in connection with Starr's investigation were grounds for impeachment.

In later years, Kavanaugh said that Clinton should not have had to face down an investigation during his presidency. He has said the indictment of a president would not serve the public interest.

Like Trump's first nominee to the Supreme Court, Neil Gorsuch, Kavanaugh clerked for Kennedy. If he is confirmed, it will mark the first time ever that a current or former Supreme Court justice has two former clerks become justices, according to an article by Adam Feldman, who writes a blog about the Supreme Court.

Kavanaugh teaches courses on the separation of powers, the Supreme Court, and national security at Harvard Law School and Yale Law School, and does charitable work at St. Maria’s Meals program at Catholic Charities in Washington, D.C., according to his official biography.

https://www.washingtonexaminer.com/...ett-kavanaugh-nomination-by-a-28-point-margin

After a blistering confirmation battle, Justice Brett Kavanaugh will take his seat for oral arguments on the U.S. Supreme Court with a skeptical public, a majority of which opposed his nomination. However, Democrats may not be able to exploit this fact in the upcoming elections as much as they hope, because the independent voters overwhelmingly disapprove of their own handling of the nomination by a 28-point margin, a new CNN/SSRS poll finds.

Overall, just 41 percent of those polled said they wanted to see Kavanaugh confirmed, compared to 51 percent who said they opposed his confirmation. In previous CNN polls dating back to Robert Bork in 1987, no nominee has been more deeply underwater.

What's interesting, however, is even though Democrats on the surface would seem to have public opinion on their side, just 36 percent approved of how they handled the nomination, compared to 56 percent who disapproved. (Republicans were at 55 percent disapproval and 35 percent approval). A further breakdown finds that 58 percent of independents disapproved of the way the Democrats handled the nomination — compared to 30 percent who approved. (Independents also disapproved of Republicans handling of the matter, but by a narrower 53 percent to 32 percent margin).

Many people have strong opinions on the way the Kavanaugh nomination will play out in November and who it will benefit. The conventional wisdom is that it will help Democrats in the House, where there are a number of vulnerable Republicans in suburban districts where losses among educated women could be devastating, and that it will help Republicans in the Senate, where the tossup races are in red states where Trump and Kavanaugh are more popular.

That said, it's clear that the nomination energized both sides, and that the tactics pursued by the parties turned off independent voters in a way that makes it much harder to predict how this will end up affecting election outcomes.

I wonder when the nu-left is going to realize the throwing an infantile tantrum and crying fascism strategy isn't working for them.
I don't know if they are capable of it collectively. I think it would take a single, dynamic person to rip the DNC from the old guard in the aftermath of another overwhelming Republican victory in 2020. Who knows if they'll be successful or how long it will take. We've seen how lost Dems are since Trump. Kavanaugh seems to have been a toe in the pool for other Republicans to switch their behavior and I think we'll see another healthy Republican victory at the polls in a month. Establishment Democrats have proven they're incapable of changing and their dwindling base is full of even more hysterical, ineffective shriekers who have no idea how to appeal to the majority. The change they need is so dramatic and all encompassing, I'm not entirely sure how they do it. They'll need to get their MSM shills to change message and I don't think they have any interest in doing so because they only know how to get views and clicks is through fear-mongering and hysterics. They've built a self-perpetuating outrage machine that people are starting to walk away from.

SNL cold open.

You know, I remember when political humor was biting, but not mean spirited. I am sure all the folks in middle America get the joke too. The bubble grows all the more opaque it seems.
Almost a million views and 12K likes in less than 24 hours, and all those comments actually applauding this and expressing their disappointment over presumption of innocence existing while mocking the turtle for not "believing women" makes me lose faith in humanity, although I never had much faith in humanity to begin with, so no real loss.

"Meanwhile, literally every woman I know - EVERY ONE - has been attacked by AT LEAST one grinning shitlord who wants to tell her how she should feel about her own traumas and telling them what opinions they are allowed to have about things that affect them."

You know the old saying, son: "If you meet a traumatized woman, you met a traumatized woman. If every woman you meet is a traumatized woman, you should probably have several concurrent life sentences."

Okay, I have one more stupid procedural question that doesn't matter at this point.

My understanding is that the results of this FBI investigation have been pretty tightly controlled. There's one copy, and anyone who wants to see it has to go physically examine under guard from the FBI.

Now, is this standard procedure when dealing with a report generated by the FBI on behalf of a Congressional investigation? If not, I'm worried it could be spun as a cover up, even if that's not true. But if it's just how things are normally handled, then fuck it.

It's abnormal. The left was going to blame the FBI anyway unless they uncovered Kavanaugh's rape dungeon where he waterboards women using kegs of PBR. I personally believe that it's being kept so tightly under wraps because it got dangerously close to implicating Ford, and possibly her DNC handlers, in illegal activities. If the report leaked, or the FBI continued their investigation, they would be forced to do something about it. There are already rumors that Grassley is pursuing an investigation of Ford. Apparently, her best friend says she was pressured into changing her story to corroborate Ford's. I personally don't expect that go anywhere if it's even true.

You know, all of these leftists cutting off their family members and calling for Civil War 2 : Electric Boogaloo...they DO know which side has most of the arable land and the firearms, right? I'm sure "beard and high heels" guy above just thinks he'll be able to don his stillettos and stomp all over the Patriarchy with ease, but I think winning an actual bullets and blood war might involve something a little more pragmatic and a little less kinky...

None of the Soy War NOW! crowd have even thought that far ahead. You'll note they never say "I'm gonna..." it's "We're gonna...." if that, sometimes there's not even a "We're" and it's just a "YOU'LL burn/be sorry"

Because they don't see themselves having to fight, they assume it will be some other group doing the actual boots-on-the-ground work in this new revolution/Civil War, and they'll be laughing their assess off over Twitter as it happens, not playing an active role in any way, shape or form. They only see themselves as part of getting the ball rolling, being the firebrand that inspires the revolution, being the Thomas Paine that writes the book that gets everyone on their side so they can send "Them" out to fight and just lay back on the sofa and wait for the glorious revolution to succeed. They don't even get as far as considering where the fighting will happen, what "objectives" will be targeted, or how, if this country ever goes to war with itself, the first casualty is going to be continuity of infrastructure, and that includes mobile aps.....

But, again, they haven't even thought that far, if they had, they'd realize that the soldier class, the very demographic that is gong to have to do the fighting, the one that the will do all the dying, i.e. - the middle class, HATES their GUTS and will gladly oppose them before they'll join them.

They have what I can only call demographic blindness.... the can't effectively see other people as part of open society... but as outliers of some nefarious "other" group. What do I mean? They fail to see, cannot see, that people they rub shoulders with on a daily basis, the clerk at the auto parts store, the cashier at the grocery, the mailman, the UPS driver, these are people who actually, by political leaning, are the enemy. There are people out there that Soy War proponents pass daily who hold views counter to them, but they cannot see it because to them, the "enemy" are these grotesque Nazis, the designated evil figureheads, Trump, congress, a game developer here, a blogger there.... they totally don't get that their "enemy" is all aground them too... which is why they have this fantasy of an easy war, they cannot see if war were declared and everyone suddenly had to fight on their side, if mid-stride at noon today, everyone dropped what they were doing and held up a red or blue flag to determine the sides.... soyboys don't get that wherever they are, they'll be fucking SURROUNDED.

So many of the tweets look so similar I wonder how many are real people sometimes. Like I can't tell difference between the articles and the twitter people now.

Oh yes, please by all means, let that juicy discovery out. Surely it wouldn't implicate Ford at all. Surely Kavanaugh suing Ford for the hell she and the dems put him and possibly his family through will solely leak out all the proof, all the evidence, all sorts of skeletons of just Kavanaugh's, and not in any way reveal what a lying sack of shit Ford is.

Don't worry, that one's definitely satire. It's making fun of all those 'woke seven year old' posts you see

TFW the timeline is such that it's difficult to separate the satire accounts and posts from the unironic "I'm shaking bad RN" ones. *sigh*

I don't know why the fuck I decided to try to search up "Kavanaugh fan fiction", but I found this:

No idea if that's a tryhard troll or a legit hardcore feminist, but I archived the profile just in case someone at FFn decides to drop the banhammer on this user.

FBI Background Investigations for Senate Confirmation are never publicly released. Doing so is illegal, and a huge privacy violation for the nominee. Only the Senators are ever supposed to see those reports, by law.

But the sealed room single copy trick is unusual for a Judicial nominee. They normally use it to secure classified documents. They did it because of the absolute certainty that the report would have been 8nstantly leaked. They had the justification because such materials had already just been leaked and triggered an investigation.

In the end that sealed room actually worked better for the Dems. Notice how they aren’t complaining about the report being private, or never mentioning any specifics? Feinstein doesn’t want it out there because it is damning of her “victim”.

Well its been one hell of a ride with an especially satisfying conclusion. As for what comes next...
Well we're already seeing the "New evidence proves Ford's story Impeach Kavanaugh!" narrative being spun.
Meanwhile as the polls ebb and flow over the next four weeks the media will doubtless declare that the GOP enthusiasm wave is waning and that means "Blue Wave/Year of the Woman 2.0".
Of course we all know that the Dems are screwed on November 6th and this shitshow is a big part of war of why. Not to mention that when Republicans get pissed off they stay pissed off. Oh and they actually go vote when their pissed off.
Needless to say the coming days are going to be entertaining.

Nobody wants to talk about it, but it's really a gigantic double edged sword for all the media outlets proppin' up this stuff. It's going to be extremely satisfying when various important people of publications like HuffPo, MSNBC and The Root all get #metoo'd and fucked over.

"Where did this passion to destroy sex offenders come from!" - Says The Root writer after getting slammed with sexual harassment allegations after getting a militant black danger-hair lady super drunk and trying to smash that.

Kavanaugh is going to spend the rest of his life looking over his back, knowing his every action could be the grounds of another witch hunt investigation. His oppressors hold grudges like no other.

Doubt it, his screechers have short attention span , just wait until Trump do another thing they don't like and they will forget about him quickly and knowing the emperor he is going to do it very soon because is fun

It's because progressives believe that they're the majority opinion. At this point they don't even understand that people they consider "on their side" (moderate lefties) are mostly against them, with more every day realizing that they're being tarred with the same brush as these loonies, and openly being against this clown-world shit too as a result. Why the media, and the D.N.C. continue to carry water for them, I don't know but I can only surmise that it's along the same reasons as why the G.O.P. kept carrying water for christian fundies for so long despite so many on the right being against them.

Well, except Pelosi, and her trying to use FOIA to release it to the public.

I suspect people from the grownup table (The Senate) might be having words with her after that, though.
