Depending on if such a book gets published and sold at bookstores, the Philly Flyers could have actual grounds to sue. At this rate, they better start taking action because this is only going to get worse.

Yes, and this is literally exactly the kind of thing that got Matt Furie to sue.

In fact, if they don't sue, they risk losing their trademark by failing to control it.

Can you elaborate a bit? Would it be because of dilution through failure to police/protect the trademark or something else?

Trademarks are supposed to indicate the origin of a product. If they fail to do so because the trademark holder hasn't protected them, or really even if the trademark holder does everything they can and it still ends up no longer designating the origin of a product, the trademark effectively ceases to exist and is no longer protectable.

In short, they can't afford to just let random people use their trademark, any more than they can tolerate people selling knockoff jerseys and other merchandise.

ETA: so far this thing is free, which would possibly not be a "use in commerce" sufficient to trigger the usual trademark infringement, but if it's used in fundraising or in any other way connected to money, it would be. Also, there might still be a dilution/disparagement argument if associating their trademarked mascot with a terrorist organization happens.

This is the bit I was wondering about. Unless my understanding is way off, it seems like the Flyers could lose their mark through dilution even without unlicensed books or other merch being put out simply because a bunch of masked faggots are using it and there's essentially no one to identify and sue for infringement.

Just one thing isn't going to lose you the mark, but if you let a bunch of little things add up, it might. So even those little things that might not individually destroy the mark can be actionable. I don't think the issue would be straight dilution here so much as tarnishment, a flavor of dilution in which the mark is cast into disrepute, in this case by association with terrorist activities.

To help with theoretical questions of whether they could be sued or not, imagine mickey mouse in place of gritty. Imagine anyone not disney attempting to sell anything with mickey mouse on it. The lawyers would be there before the ink dried on the books.

I take every day that goes by without the flyers suing as an endorsement of antifa. And now I have to figure out a way to watch a negative amount of hockey to punish them for it.
