Actual the Supreme Court itself did it. It’s just nobody realized it yet. In Roberts original and completely insane decision he basically declared that Obamacare was only constitutional because the wildly hated and unpopular IRS enforced penalties made it a tax, and thus subject to the loose interpretation of the 16th amendment “we can do anything we want if we call it a tax, even if we specifically state it’s not a tax” clause. So under Roberts the only thing that made it constitutional were the penalties. Congress removed the penalties 2 years ago. Thus... this Judge simply obeyed the full text of the Roberts ruling.

Precisely. I know it sounds odd, but the difference between 'I disagree with you, but I'll hear you out' versus 'I disagree with you so fuck off and die' is profound.

The former still extends the concept of legitimacy to your opponent -- that even though you may think they are wrong, they aren't 'mayonnaise ghouls' or some other charming epithet. That they're still human and that their ideas -- even though you might think them wrong headed -- still mean they have some worth.
