I do wonder if some of these FB lawyers are in different countries and are talking about their flawed understanding of their own legal system and imposing it on the US's. Some of what he's talking about lines up with my own minimal knowledge of places like Britain's civil law (biasing the jury specifically, but I don't know how that's used in normal civil cases if at all).
 
You know that makes me wonder: how are juries in civil cases picked?

I know in criminal trials (since I've been in jury pools before) the defense and prosecution go through prospective jurors to find ones that ostensibly seem unbiased (or better, slightly biased towards their case). Similar thing in civil? Random jurors? Something else?

I'm in a jurisdiction which has a sub judice rule for criminal cases. Both prosecutors and defence counsel still bluster to some degree. If the judge is really concerned about proceedings being undermined they will issue a suppression order (which they did with a very high profile case which recently concluded here) which prohibits everyone involved from talking about it until the suppression order is lifted.

Well, we did have that one self-proclaimed "English Magistrate" who claimed that Funimation wouldn't be forced to turn over anything in discovery due to the 4th Amendment.

That's a guy from one legal system misunderstanding the US legal system.

Also, he's likely not a Magistrate. He has an ED article.

But, mostly, they're just dumb.

I learned something from that. We have magistrates here but they are local court (the lowest court here) judiciary, not lay people. Our justice system derived from the English justice system so I was a bit surprised to learn about that difference.
