We need to pardon people that flip it when they witness sexual assault that in progress and come the the defense of the victim . Is it not within our right to defend others that are in danger?. I swear, it's damned if you do, and damned if you don't and if they charge him with assault, then it's a broken system and their will be riots.
Some states have laws that were never updated for [CURRENT YEAR] in which a clear-cut case of defense of oneself or another still needs to be tried. However, even with prosecutorial discretion many "victims" in situations like this push for charges, which leads to instances like this where they have to go through it. At the very least they have to provide it to a grand jury and they have to provide only the evidence that would be used to convict, leaving out exculpatory evidence. It's a shortcoming, even I'll admit that.
There was a case a few years ago where a Texas man walked in on a farmhand raping his daughter. He got his daughter out of there then went back and beat the man so bad he died. The guy called 911 to report it and he didn't mean to kill the guy. They decided not to charge him because it was defense of another, and they knew no jury would convict.
